My estate agency will not repair the problems the house im renting?
please help i am renting a property from an estate agency who promised to fix a few repairs which need doing:
The letter box is broken
The door bell don't work
The tiles in both bathroom are all cracked and dangerous
The light in my little girl bedroom doesn't work all the wires are hanging out the ceiling
And the whole house is so dirty
There are other problems but the list goes on i had the manager of the estate agents come round and i paid my months rent to him and he promised the work would get done but 4 weeks on and no work is done i haven't paid the last months rent as i dont think i should and they keep phoning me cause i am in rent earears what can i do as these estate agents only seem to want to get there money and not worring what state the house is in thank you all the advise i can get would be appreciated.

You have done yourself no favours by not paying your rent. You pay rent to live in a property so by doing this you are stating that you think you are entitled to stay there for nothing and if thats the case then move out and find somethething more to your standards. Your Landlord has a duty to maintain the property to a safe condition but you should check your agreement as most assured shorthold agreements show a clause that states you as a tenant will have the role of any other householder and smaller repairs and maintenance (the ones i use state £25.00) are down to yourself if below that threshold. In real terms you are asking for work to be done but are in rent arrears. Your local Environmental Health office can help you by visiting your property and then assessing any risk to yourself due to the repairs. They will then contact the Landlord and serve a notice for remedial works to be done in a suitable time scale should they feel it appropriate. Unfortunately you will probably now find that an eviction notice or order for possession is served on you as you are in arrears. Good luck and I hope you get everything sorted.

That is how Estate Agents work. Try contacting the management company or the landlord bypassing the Agents. I think the dirty thing is up to you to resolve. The bottom line is if you did not break those items and can guarantee this then you have a chance to get these items resolved. Try a small claims court action. It costs about 35 UK sterling and no company would want a SJ (think called this) against them. MAKE SURE THE HOUSE LOOKS CLEAN BEFORE put everything in your favour otherwise shoot your own death.

You might say you shouldn't do this on principle. Well, carry on living in a poorly managed house and stop complaining to do it yourself. Or stand up and get your justice. Good luck.

You cant just withhold the rent just because there is no work being done. You need to go ahead to pay your rent, both current due and past due. Also, read your lease to see what it says about maintenance and who is responsible for it. The agency has to provide the basics like heat, hot water, etc. You may also have the option of the court having an escrow account, where your rent will be held. You have to ask about this, though. I am not sure how all that works. It varies.

The next time you get them out to the property, have what repairs that need to be done in writing. Have them sign this, as well as a copy for yourself. They have a time period after this to do the repairs. If you do this to no avail, you need to write your agency a letter stating the problems that need fixing and keep a copy for yourself. Specify in this letter how long they have to fix the problems before you will take further action. Send this letter certified with return receipt as this will prove that they received the letter. If after this length of time has expired and no response is heard from the letter, then you need to write another letter, again sending certified with return receipt, with 30-day notice of your leaving due to their failure to maintain the property. If they take you to court over this, then you have the proof you need to show that you notified them and gave them ample time to perform the repairs.

Make sure to check your landlord-tenant laws where you live since they do vary from city, state, county, etc.

First thing is Karlie, the estate agency are the owners agent and cannot authorise repairs without his/her say so. they will report your problems to the owner and give him an estimate of cost to have the repairs done. If he says no, then no it remains. With holding rent is not the way to go here!

After writing to them and no response of your repairs, you as the tenant have the right to take some of the rent money and make repairs of your own and send in a copy of the repair bills with next months rent with money deducted to show probable cause of the money being spent on repairs to the place. Holding the money can get an eviction if you go to court the judge will want to know is the money saved and put in forms of M.O. or C Check so know what your doing.Take before and after pictures and duplicates, send one set to company and you keep one for your records.

You need to make a formal complaint to the estate agents, write it out to the manager/supervisor, list all the problems in order or importance apart from the dirty bit. If it's dirty you have to clean it unless it dirt due to mould or bad decorating. Print out or write out three of the same letter, sign them all. send one to te estate agent giving them a week to reply and a week to repair everything. make sure its dated.

If they don't reply call your local council housing office who can arrange for an official inspection of the property and make the estate agent fix and problems. If they do not they can be brought up in front of a court which they won't like. Send the person that deals with your problems the 2nd copy of the letter you sent to the estate agent, this will show that you have complained and they have failed to respond.

That should be enough to get things fixed and too a better standard then they are in now. But don't withhold your rent, it doesn't matter whether things are broken it's illegal not to pay your rent and you could find yourself being evicted and homeless. Don't give the estate agents anything they can throw back in your face!

See a solicitor or Citizen's Advise Bureau as soon as you can. Write a letter to the Estate agency detailing your complaint and stating why you are withholding the rent. Take a copy of the letter to a solicitor or CAB. Good luck and don't be bullied, you do have rights.

From the tone and sound of your post.
You need professional guidance.
The real estate agency has an advantage over you. You are going to have to insulate your self with documentation.

Be accurate and correct. Don't mention that you are living in a "whole house that is dirty" They are going to say "you are living in the house, clean it". Inside the house being dirty is your standard of care.

4 weeks is too long for a professional agency in responding. Write them a letter.
If you don't want to do any of the above or what anyone else has to offer and not mitigate your situation.......Then you may take the the moving out way. The court is going to ask you why you stayed there in that mess.?

Formally write to them to inform that you won't be paying them until the house is habitable. List the problems, discussions to dates. etc.

Do this now as you may well be liable for any rent until you actually send/give them the letter.

Failing that, look for somewhere else.

If you know who your landlords is then contact them direct. The agency works for a landlord. If not ask the agency. if they wont tell you, tell them if nothing is done within the next say 2 weeks then you will contact your local council. Your local council may well be able to help you. Alternatively seek advice from your citizens advice bureau
