My ex boyfriend and I bought a house together a few years ago. I left him 16 months ago because he was cheating on me. He cannot refinance the house on his own because he took out a 2nd mortgage and he owes $160,000 on a $135,000 home. He currently lives there with one of his friends and his current girlfriend. My name is still on the mortgage and he is currently 3 months behind. He always makes excuses and tells everyone he is going to get it paid up to date but he never does. I have contaced an attorney and I am being told there is really nothing I can do without taking him to court and spending thousands of dollars. I need to know how I can make him sell the house, he refuses to do anything and when he does it is the minimum to keep from going into forclosure. |

you should have foresaw this situation before signing your name to a binding agreement. Your attorney is right, he doesn't have to do a dang thing and if he lapses on payment your credit will suffer too. If you are so bent on trying to get out of the house... take him to court or else suffer in sad realization of the brat this man who used to care for you has become.... Good luck either way. |

You are in serious trouble with this deadbeat. It sounds like you'll need to take him to court. As long as your name is on the mortgage, too, your credit is getting damaged due to non-payment.
If you don't take him to court, then it sounds like you might end up filing for bankruptcy. |

Right now w/ the way the mortgage maket is, no lenders will touch a +100% Loan to Value home, heck he'll find it equally impossible to get 100%. Your best choice in the long run is to take him to court. It'll help protect any further damage to your credit, which could take up to 7 years to repair after foreclosure or default. |

You need to see a lawyer. States vary. In most states when you sign the mortgage paperwork that is saying I'm responsible, unless you legally remove your name you could be responsible. |

You seem to have a problem on every angle. You can probably come off the deed by doing a QUIT CLAIM DEED, However you are still responsible for the loan. There is no way that he can sell a house that is worth $135,000 for $160,000 because now he has negative equity meaning he owes more that what the house is worth. I suggest you contact the mortgage company and explain your problem they might give you better advice |

ask him if you can sign the deed over to him, this way you name is not on the title and ur not obligated to the pay the debt. either way his non payment is damaging to both you and his credit. try calling your mortgage lender, explain your situation, they can better advise you. |
