My ex-fiance & I were together 7 yrs. We bought a home together. Two yrs ago he revealed to me that he owed the IRS $250K. After complete shock, I agreed to take a 2nd out on our home, but the lienholder would not do it unless my fiance was taken off the deed of the house. This was done, leaving ME responsible for HIS debt. He assured me he would pay it back to me. I would not have bailed him out, but my mother was terminally ill & staying with us at that time & the stress was too much for me. I caved. Later, my mother passed away. He has been intimidating me with lies ever since. In May, I couldn't take living with him anymore, as I discovered he is quite a conman. I moved my things out of the house I now own by myself. He refuses to move out. He's threatened to 'trash' the house if I 'try' anything. I've discovered many things about him...he's quite a con man. He just recently filed for bankruptcy, naming me as one of the people he's unable to pay. He said he didn't know his lawyer was going to do this...of course, I know this is a lie. He does not have a job, but is working under some capacity and now I discovered he's renting a room to a woman, getting her to pay HIM & all without my permission. In fact, he hasn't had permission to live there since I moved my stuff out, told him to leave & wanted to sell the house. Does he have any right to stay there? Let alone, claim bankruptcy & them rent a room to somebody in a home he doesn't own? Additional Details He is off the deed and title. The lienholder, along with the IRS, forced him to sign a quit claim & be removed off the house altogether...in order for me to obtain the $250,000.
When I moved my things out, he had the nerve to accuse me of looting MY own home...laughably, the garage remote...he put it all in writing, entitled, "Stolen Items."
He has been in real estate as a career, but has pretty much been blackballed in our area. But he had me believing I'd signed an additional 'quit claim' & that he could 'deed' himself back on my home whenever he pleased. I know I should have been more diligent in checking out all his intimidating statements, but I feel like I'm a character in a bad movie! I shouldn't have signed for the 2nd...it was stupid of me...but it's done. I can't sue him for the money, because he's claimed bankruptcy & named me as a creditor he can't pay. Can I file bankruptcy, too. At this point, it can't hurt me any worse. |

Get a lawyer! It may seem expensive now, but after all he's trying to put you through, it won't seem like a drop in the bucket! Speak with a lawyer and get their advice, then call the police. Get him out of there. Change all your phone numbers and stuff and get away from him! He's toxic! You don't deserve that! |

if the house is under your name and yours alone it is YOUR house. call a lawyer to find out what to do about this jerk and the woman hes renting to. or what i would do is move back in to make sure he doesn't trash it and kick the woman out. she's supposed to be paying YOU money and show her the paperwork that proves the house is yours and not his like hes making her believe. tell her if shes not out in 24 hours you will be forced to call the police and have her arrested for being on your property...in fact tell that to your ex too... |

You first need to get yourself some legal help and find a good lawyer that can answer questions for you on this. Each state has its own set of laws that govern this kind of thing, but I'm pretty sure in this case he has to be in the wrong. Secondly you are going to have to show up unannounced to get him out and you are going to have to have law enforcement with you. It sounds like you have a very nasty messy situation on your hands and I hope it works out the best for you. |

Get a solicitor and get a court order to remove him from your property, go to the police and say you have a court to re-possess your house and he is threatening to trash the house. You should have never moved out for all you he has changed the locks.
The other thing you can do is wait until he goes out and get a carpenter lined up and change the locks. remove all his goods and put them outside , if need be hire a security company or a firm of body guards that will stop him also when you are in court get an order banning him from the property if he tries to break in then go back to court and have him charged with contempt |

and you will likely need to sell the house.
if you can sell to a relative, you can easily buy it back.

To say the least, your 'ex-fiance' is a scoundrel! If it were me, I'd get a restraining order against him -- since he has threatened to trash your home. I wouldn't deal with him directly. I'd go to your home when he's not there, get help moving his things to a storage place, have the locks to the house changed. I'd hire somebody to watch the house (or tail him) and call the police if he came anywhere near the home. I'd have documents ready to show he has no rights to your home, tell the lady tenent to take a hike, put the key to the storage unit in an envelope, get it delivered to him - somehow - with a note telling him the key to the storage unit with all his things is enclosed...stay away from me and my home...and while he's at it, 'go pound sand!" Bye, Bye...don't darken my door again. |

You will need to give him a 30 day notice to be out by the end of September. Remember to date the notice. Send it to him by certified mail with a return receipt. Send him a duplicate by ordinary mail. The return receipt will be evidence that he has been served, or he ignored the service. Save the receipt from the post office. Do not talk to him. Do not not discuss what you are doing or intend to do. If he has not moved at the expiration of the 30 day notice you may start an eviction action in small claims court. Some people use an attorney for this. If he damages the property you may get a judgment against him for the actual cost of the damages. When you win your eviction, the court will issue an eviction order to the sheriff. You will need to take this order to the sheriff's office and pay the costs of the eviction. You might need to arrange with the sheriff for you to be there when the eviction occurs, so the the sheriff does not have to break down the door to gain entry. If he returns to the property after the eviction, he may be arrested for tresspassing or illigal entry. |
