I think that everyone here pretty much asnwered your question correctly. You need to ask your landlord for a payment proof or receipt for the amoutn you are paying and take your ex to small claims court to get your portion of ther money. You might also include your moving expenses, if required, or any other expenses that proved to be harsh for you such as utility bills, etc.

You need to check your lease agreement.

The best thing to do is NOT SUE HIM and try to get someone to take over his part of the lease. Then go after him for anything that you had to cover while searching for a new person.

If he will give you the money without going to court, it will be much easier for both of you.

sshazzam
Hell ya you can. Kick him in the nuts!!!

You can sue anybody you want. Whether you win is another matter, and whether you collect anything is still yet another matter... In the meantime you have to pay.

conundrum_dragon
If his name is on the lease with yours probably..talk to a lawyer.

Honey83
yes you can sue him.

Why not I mean someone sued McDonald;s because they gained so much weight I mean who would do that.

geet840
Absolutely! (he did sign the paper work right?)

bootylucious_1986
yuppers you can sue his pants right off his loser butt. take him to a civil court and sue him for the rent and for pain and suffering thats what most folks do!

yes, by all means, however, you may end up with huge expenses doing so, you should seek legal advice, you may be able to access legal aid, ask centerlink if they can get you an appointment with a welfare worker and or councilor

as long as his name is on the lease too he's responsible. I'd take his *** to court. He's also responsible for any utilities he didn't pay for.

Mom of 3
If his name is on the lease, then yes you can. Unless he gave your proper notice of his intent to leave, giving you an opportunity to find a roommate, then he is legally responsible for 1/2 of the amount for the duration of the lease. Good luck
