Ashthew | My ex-landlord has taken an extra month rent after I have left and ended my agreement, how do i get this back? |
i left the flat in december however an extra payment was taken from my bank to the company who had arranged the agreement. I informed them immediately however they chose to still make the payment to the landlord. I have been chasing this on a daily basis however the only response I am getting is they are waiting for the landlord to return the payment to them via a cheque before they can in turn refund me. I have since had my deposit back however this money remains owed to me. I have run out of ideas to get this money back now as I am given the same excuses from Newton Holly homes.
can anybody help? Additional Details the agreement had expired and the money was taken from me incorrectly. The third party are refusing to give me details of the landlord other than he lives in Ireland. The payment was taken from my bank on the 13th December |

You must go to the hall of records and find out who owns the property. It should be public information. They should also have a mailing address for the owner. That way you can contact him/her directly. That might be enough to motivate him/her to give your money back immediately. Good Luck! |

Speak to the Citizen's Advice Bueraux for free advice, however you should bear in mind that the agency has the agreement with you, not the landlord. The agency cannot hide behind the excuse of 'can't contact landlord' or 'waiting on landlord'.
Put the facts in a polite letter to the agency and ask for a response within 7 days. If this is not forthcoming, it doesn't cost a lot to use http://www.moneyclaim.gov.uk to start simple legal proceedings against the AGENCY. You might find that they will pay up straight away.
You should hurry - an agency tried a very similar thing with me a couple of years back, although in this case I actually knew the landlord - she lived across the road. The agency were telling me that they were waiting on the landlords confirmation everything was OK with the house. The landlord was telling me that it was fine, but that she'd not received rent in 2 months!! The agency had 2 months rent money and my deposit! We both threatened legal action and this got the "unfortunate mistake" sorted out quickly. A couple of months later the agency went bust owing a lot of people a lot of money. So don't rest on your laurels - get it sorted! |

Have you tried contacting the landlord directly? They may be able to refund you directly instead of going through a third party. Bring a copy of your lease and bank statement to the landlord, anyone in the office should be able to help you. If you have no luck with this, go down to city hall. Every city hall has an office that deals with housing, they actually grant your landlord permission to do business within the city. Explain the situation to them. You should have your money back within days of the city calling the landlord. |

Even when you rent through an agent your lease should contain full contact details for your landlord.
The payment will not have gone to the landlord but to the agent - that is what an agent does, puts in tenants - looks after the property - and collect the rents.
Your beef is with the agent not the landlord though he or she should certainly be told about the situation. |

i assume from your wording you are in the UK. Go to google and type in the words "small claims court" and follow the advice, you will recover your money no doubt. Believe me, i have used them |

If your contract was between you and the landlord you need to get the money from the landlord. However, if the contract was between you and the company (check it) then it is up to them to give you the money and for them to get a reimbursement from the landlord. Write to them giving them 14 days in which to refund the amount, which has been taken illegally, and tell them in this letter that if you dont receive it within the time scale, you will take the matter to the Small Claims Court. Keep copies of all letters and details of all phone calls made. You are within your right to file papers in the small claims court for this amount and any expenses - it will cost you a nominal amount which will be reimbursed when you win your case. However, make sure you are taking the right person to court - landlord or his agent - check who is named on your contract. |

If you are in the USA, there is a form you fill out with your bank called a Regulation E form, it disputes the entire transaction. You would need to take your lease and all supporting documents to the bank and with in 30days the money should be returned to you. |
