Blond&Tall | My fiance and I are renting a Condo my Dad owns? |
I am living in a very new (we are the 1st to live there) Condo my Father owns with my fiance. We have lived there with my younger sister (the 3 of us) for the past year and she just moved out. My sister never paid rent to my father because she was in her last year of college, but my fiance and I have been. We saw the state of the room she used to live in yesterday and it is absolutely disgusting. Bleach and dirt stains cover the carpet and walls. It looks destroyed. We had no idea the room was going to be in this condition when we agreed to pay extra rent. She left her room a mess. My father calls himself a landlord, but is claiming my fiance and I need to pay to have the carpet and walls fixed. We don't agree? Should we have to? Additional Details Thank you so much for all your answers. We do not have a written lease. We live in Maryland and we have an "oral" lease. No you shouldn't be responsible for the mess your sister left behind we she vacated the premises. Your FATHER needs to step up and handle the situation in a professional manner. If he was renting to someone else he would have already came in and taken care of the situation but since its you he is like oh well whatever she is just my daughter he thinks he can push you over like that and I would stand up to him and tell him NO. sounds like you should contact your sister as well and tell her to come clean up her nasty *** mess she left behind just goes to show ya what kind of person she is If she's not paying for it she isn't going to appreciate it. |

If you were renting from a regular landlord (not family) then she would be responsible (your sister). You could sue her- but ultimately since you were staying you would probably be the ones to do the work, otherwise landlord would hold your deposit & charge any excess to you when you left.
However in your case- I would say that your father should hold your sister responsible- why should you be the ones to pay? |

I agree with the above poster about rocking the boat, what should happen and reality seem to be different,
sounds like your father has a certain view, you can fight that view and rock the boat not knowing your situation but it could lead to him not renewing the lease |

NOPE. If your father is "landlord" and your sister was a nonpaying tenant, damage is between the landlord and tenant. You as a new tenant (for that room) ask the landlord to repair damage, or to be aware of damages.
Why is he stating you should make the repairs? Don't want to create a huge family fight, so be willing to compromise.
Why isn't he making your sister do anything about the mess? She's old enough that she should be held accountable for her actions, and he's doing her no favors by dumping her mess onto you two. |

It sounds like your sister needs to learn some responsibility and come back to work on the room. If your dad won't make her do it now, then she will have a much harder time learning responsibility in life. You shouldn't have to fix anything that you are not responsible for. |

Move out and find another place. It's much simpler that way.
If that's not a good option for you, explain to your father that your sister should be responsible for the cleaning and carpet since she was the person who lived there before you. New tenants aren't expected to pay for the cleaning of previous tenants' messes.
Explain to him that it's his responsibility (legally) to fix the problems in a "new" space when a tenant takes over that space. |

No, but your father seems to think so, sounds like favoritism to me and he really should make her pay but maybe she's his favorite? Parents often have one child they favor over another one, but since you are living there, just clean it yourself and make sure your sister knows what she did...take photos too so you have proof. You have a pretty nice situation otherwise so don't rock the boat. |

Go to your local courthouse and get the landlord/tenant rule book . It will instruct you on the steps to take to legally get the repairs you need. |

Like it or not, your dad is right, and yes, you should have to make the repairs.
If you were renting from a "regular" landlord (meaning "not your father") and your sister caused this type of damage, the landlord would either (a) require that you repair the damages to his property, or (b) repair it himself using the security deposit you paid before you moved in. There would be no leniency, no negotiation.
You state very clearly that the unit was new. Any lease I ever read requires that you return the unit in pretty much the same condition, excluding what might be considered "normal wear and tear." Bleach stains on carpet and walls isn't normal wear and tear. There was damage to his property, and he has a legal right to have is property repaired.
What does your lease with your father state? If your lease only lists your and your fiance's names, then the two of your are the tenants and responsible for any damages to the unit made by you or your guests. Your sister would not be considered legally obligated for the damages because her name isn't on the lease.
Your beef isn't with your dad, it's with your sister. Get her to help you clean it up or pay for it. If you can't, then you'll just have to chalk it up as a loss. |

the names on the lease are responsible. If its your name on the lease youre responsible for any damages caused during the term of the lease. If your father has landlord insurance or any insurance that will cover damages ask him to make a claim and ask your sister to pay the premium. Explain to your Dad that this was not your fault and it was your sisters. However if he wants to be nasty and your sisters name wasn't on the lease you are liable for the damages. Renting from family is always a bad idea it causes too many problems maybe you should both move out to prevent fights. |
