My friend called very upset, she just got a 5 day eviction notice for non payment of rent?
she's been in constant contact with landlord regarding repairs being needed to her toilet. shes been waiting sense february for the repairs. as it stands now, shes fearful of even sitting on the toilet for fear of falling thru the floorboards onto the kitchen. shes been paying rent but contined remind him about the repairs. in her frustrations, she told the landlord, no more rent until the repairs are made. still no repairs were made. second month she didnt pay rent he called her asking for it and she again told him you want your rent fix my toilet. im afraid for my safety and im now living with mold. she just received a 5 day eviction notice. she has 5 days to get out. if she's month to month, isnt she at least intitled to 30 days? she could have easily used the rent money for repairs but then that wasnt as easy as it sounds because the estimate she got far exceeds the amount of the rent. i told her to stay in apt and let him sue her, let a judge work it out, was this good advice?

Just for future reference… Always go to your bank and open a separate account marked “escrow” and make sure the rent is put in that account each month. Send a certified letter to your landlord stating that you are holding the rent in escrow until the repairs are completed.

With that said, she needs to get on this TODAY. She made mistakes so she may end up loosing but at the very least she’ll have more time. Each court district has a Renters/Landlord court. She needs to go there today and file an appeal or a “stay” depending on the state you live in (the court clerk will tell her). She needs to take pictures of the toilet and any documentation she may have (a letter she wrote the landlord, an estimate for the repair, anything that is in writing). She should also have copies of her bank statement showing the money has been in her account. It may take her a couple of days to get the paperwork together but regardless she needs to get to the courthouse today. Good luck!

§ 8-211. Repair of dangerous defects; rent escrow.


(i) Refusal by landlord to make repairs or corrections; action of rent escrow. If the landlord refuses to make the repairs or correct the conditions, or if after a reasonable time the landlord has failed to do so, the tenant may bring an action of rent escrow to pay rent because of the asserted defects or conditions, or the tenant may refuse to pay rent and raise the existence of the asserted defects or conditions as an affirmative defense to an action for distress for rent or to any complaint proceeding brought by the landlord to recover rent or the possession of the leased premises.

She will be evicted if she doesn't move out. The evicttion will go on her record and make it very hard to rent another place.

Some state allow a 3 day notice if the tenant has not paid the rent.

The laziness of the landlord to make needs repairs, unfortunately, is not a valid reason to stop paying the rent. She either needs to move out or try to make nice with the landlord until she can find another place. He'll probably want late fees, etc in addition to the rent owed.

She does not get 30 days, she is not paying rent.

She did not have the right to just decide not to pay rent. She will seriously loose this in court.

Not only will she owe for the back rent, but interest and legal fees too. The eviction will be on her credit report to show other landlords she does not pay rent, and future employers that she is dishonest.

She violated the rental agreement and does not have a leg to stand on. It is obviously not true that she was afraid for her safety, she stayed in the apartment. This agrument only works if you leave, not just decide to stay and let the landlord support you.

She is not entitled to anything, she really screwed up and this will follow her for many years.

She did not go through proper channels. Non payment of rent was the wrong thing to do. She should have called the health department. She should have asked the city, before she stopped paying rent, at least she would have found out what the procedures are in your area.

She should have given him notice of move out. He was in violation of the lease by not having proper fixtures, I'm sure this was in the lease somewhere. A lease is a two way street; he promised to have a habitable apartment and she promised to pay to use the space.

Now this little problem is going to follow her around because it will be a mark on her credit report.

well sorry to say but he has the right to do that..some staes say 3 days is enough. .
the owner after 5 days can lock her out for non-payment.
She should have made the repaisr and taken it of the rent which is legal in all states as long as she kept the receipts of all work and materials.
the longer she stays without paying and once the 5 days is up the landlord will get a court order for remaoval which can take a few days ..unless he has friends in the system.. and once he has thta he can go with a shriefs deputy and have her removed at anytime.

Tenants can NOT just arbitrarily withhold rent without going through the proper legal procedures. Her bad for not following the law...landlord can and will sue for back rent, late fees, court costs and attorney fees. Tell your friend not to take the law into her own hands...no matter what the reasoning may be. And..NO...you advice was not good. You friend will end up with an eviction on her record as well as a major ding in her credit report. BTW..30 days notice is for people who pay their rent...not for deadbeats who don't.

she ought to be glad to move, since it is so terrible of a place. The 5 day rule to get out is legal.

NO, bad advice - She is in the wrong - sorry. You CANNOT withhold rent for things needing to be fixed.

The proper avenue would have been to send a certified letter stating the repairs needed, the landlord then has 30 days to make the repairs. If still not done the tenant has a right to get fixed by a licensed contractor and withhold ONLY that amount from the rent with receipts.

Your friend went about this the wrong way. Since she is now over 30 days behind in rent, the landlord can pull this. She should have contacted one of the news stations 'trouble shooter' teams and had them assist her. Now that she has refused to pay him, she is the one at fault.

Your friend should have went to the court and asked if she could place her monthly rent in an escrow account. It wouldn't go directly to the landlord, but he couldn't evict her if she had done so. Since she did not contact a lawyer or the court or a housing association about this, he can evict her immediately. He does not have to give her a 30 day notice for eviction. The sheriff can come by and physically remove her from the apartment.

call local dept of housing if there is one and complain about teh living conditions - and he has to go thru a long court procedure to get her evicted - tell her not to pay July's rent and then move out at end of July - (using security deposit for the rent) - there is no way he can legally get rid of her any sooner than that
