mark | My gardener found what looks like a dead body in my backyard. Do I have to disclose this when I sell my house? |
It has been there for quite some time and if I call the police they will probably insist on digging it up. But that woud destroy all the Panama White roses I have spent years establishing.
I would just rather let sleeping dogs lie, so to speek. |

a. If there used to be a cemetary there and the body was buried there legally, then you do not have to call the police, but you may have to disclose that the property used to be a cemetary.
b. If there was never a cemetary there and the body appears to be from within the last 100 years, then you should tell the police because it might be a person who was murdered by someone who is still alive, and arresting the murderer is more important than your roses.
c. If the body is from more than 100 years ago, then even if the person was murdered, the murderer is probably dead. |

Your Gardner found it so it is his. So no you don't have to disclose it. Besides your Gardner is probably the one who put there. No wonder the roses are doing so well! |

how about being charged with several felonies instead. okay for one you and your gardener can be charged with evidence tampering, something to do with a corpse ( icant think of it right now), conspiracy, impeding an investigation, etc. dig up the damn roses put them in pots or build a garden box and call the %&*@#!$ police! Naw. Just put the body back in the ground and place a headstone over it. You can tell the authorities that you are keeping a private cemetery in your backyard. Just make sure you have the proper permit. |

Are you kidding? With all the freaky morbid people out there, if the cops were to dig out a body from your back yard, you would have no problems selling as long as it showed up on TV! |

Panama White's do thrive under these conditions and home buyers look for lush landscape when they are shopping for real estate.
Since everyone would agree that the Panamas must stay, what would be the point in bringing up old news? Of course, you must correct the defective condition that allowed the gardener to reveal this distressing situation, just as you would need to fix a leaking roof. |

It's my understanding that the decaying corpse would actually leach off compost like materials, thereby enriching soil. Composting is very "in" these days. |

Don't disclose it. Just bury it again where you found it and leave it's close on. If you take it's close off you'll likely get your fingerprints and DNA all over it, then you might become the suspect in a murder investigation and I can tell you you don't want that (don't ask, my lawyer says I can't talk about it anyway). If you like the close it is wearing, go buy some close like them, it will be cheaper than attorney's fees and besides that, the close on the body may not fit you. |

that creepy you should call the police. What if its someone who was missing and their family never got closure :( |

I'm sorry, but if it is a human body, you need to advise the police. Hello! Does it have to be disclosed, well if you are an honest person, yes. If you don't and the new owners find out and it causes them to lose sleep, you could be sued.
Wait a minute, did you put that body there and you're afraid of being arrested? lol Sorry even dead dogs bark like heck!
What is your address? |
