Are they asking for the full balance even though they took the house back? Or is it just the difference between what was owed and what they were able to sell the house for? If it's the full balance, you could fight them on that, but if it's the difference, you really do owe it. |

they should only be coming after you for the difference between what they sold the property for and what you owed them. Remember that what you owed them will include any costs they incurred in the foreclosure process. A foreclosure usually costs the bank around $40,000 which they will tack on to the balance of the loan.
As for avoiding it, it is money you borrowed. |

You can't really "avoid" it without legal intervention. You need to retain a bankruptcy attorney to help you through this. |

See a lawyer who specializes in bankruptcy and foreclosure. You need expert advice, not the kind of answers you will get in this forum. Also, you may have tax consequences from a short sale ( if the bank sells the house for less than the mortgage balance). So, even though it is tough to pay a lawyer, it is in your best interest to do so. |
