Only their income counts, your will not.
You really should cut those apron strings, it is time for your husband to grow up and stand on his own two feet. |

There is no such thing as "co-signing" a mortgage. Unlike cars and other loans mortgages have owners of the property. The person(s) acquiring financing will be on the loan and the deed.
If your name is not on the loan the only way to get your name on the deed is to file a Quit Claim Deed. This is a deed that would be signed by the mortgagee and yourself adding yourself to the deed. Costs appx $250-$350 with an attorney depending on your location. Deeds do not affect credit.
If you are not on the loan then your income cannot be used. Credit would only be affected if the loan is reporting to the credit bureaus - thus your name would have to be on the loan to benefit. |

Isn't Job #1 to clean up your credit? Better credit means lower rates and better terms. Start by cutting your budget to the absolute bone and saving as much money as possible to a sizeable down payment. Get second jobs. Ask the lender how to improve your numbers.
But beware of the co-signer. Many co-signers think they have a say in all things concerning the house. I have seen many Questions here from co-signers who want a say on improvements and even control over guests and what color paint you use.
Be clear with mom that you love her and respect her, but the house is yours and yours alone. And be aware of the re-fi rules and as soon as you can get her off the mortgage. |

Giving your mother in law any kind of authority or control in your personal life is a total mistake. Don't do it, you may not see it now, but it will eventually cause ulcers. I know that, and your mother in law knows it. And she's smiling! |

I can't really help you with the whole loan thing, but I strongly suggest you dont let your mother in law have any authority. If, god forbid, something happens to your husband (either a divorce or death) your mother in law will have the rights to the house. Since the house isn't under your name, you'll have no rights. It has happened to so many people and I strongly recommend that you cosign and no your mother in law. |

If you are not on the loan, your income will not be counted in the qualifying process. That is the rule. In real life, there is a good chance that the bank will see that you have extra income and they will be more generous.
Your bad credit means that you can't be trusted to handle your income well. Explain to the bank that you have learned your lesson and you now pay all your bills on time and in full. |

Any income that is used must be from a person who is a signer on the loan. Also, if memory serves me the co-signer's income has to be half of the total income that is used to qualify. This may not be accurate if you are using an FHA loan.
You should be able to look up underwriting details for Fannie Mae, Freddie Mac and FHA loans online.

if you are not on the application or loan then you don't exist as far as the bank goes. Are you on the deed with your husband? If not, then this house is not yours it would belong to your husband and mother in law.

Put your name on the application as you income would help you qualify for a better mortgage. Your income shouldn't be on there if you are not on there. Which begs the question, if you both have bad credit why aren't you both applying. It sounds suspicious to me, if you are married you should both be applying together. The more people who are paying on this, and have an income that can pay towards it, the better chance you have of getting the loan. As well as you need to have YOUR NAME on this mortgage because if you don't you could find that TITLE will be put in your husbands and your MOTHER-IN-LAWS name. Then you could be screwed some day. If your mother in law wants to help she will do it with both names one the application, if she doesn't, she may be a kaniving ***** like mine. Watch the hand that is helping you, particularly when it is your mother-in-law. Now I do not want to stir up trouble where there is not any to begin with, however you should always cover your ***. All the best laid plans can go awry, should that happen, you want your name on that title. The mortgage doesn't really matter if you were divorcing, but you want title in your name. If there is a GOOD reason for you not being on the mortgage app. the talk to the mortgage broker & real estate agent to make sure when title transfers, that the title to the property goes only to you and your husband. I have been in this situation and was told that they could co-sign the mortgage and not hold title. However there was a snag along the way & the agent was a dunb *** and my husband just went along with the flow and we ended upwith the title in the hags name. And I think she either expected it to be that way or when it happened it was a power coo for her. Our life was a nightmare for two years because of the hags, interfering in everything & thinking she owned our house even though she was not paying a dime on it. When my husband tried to get it in our name she started some song and dance about if he died she would be left hanging, because I wouldn't pay, & she would not do it. Crazy hag, in reality, if I/we stop paying the mortgage the house doesn't stay with me free & clear, there is still a lien on it. You pay the mortgage or lose the house. So, I just do not want to see any one else in that place. Good Luck. CYA |
