He has to legally evict her. Since she has no written lease she is legally "month to month". Since she pays no rent he simply has to issue her a 30 day notice. If she is still there he needs to file an unlawful detainer with small claims court.
If he simply throws her out, as many are suggesting here, he will find himself thrown in jail. It is illegal to throw anyone out without a court order. Even then, the sheriff does the throwing, never, ever, the landlord. |

No, he doesn't have that right.
Lease or no lease, she has a valid tenancy.
You have to follow the proper legal procedure to evict her.
Find out what it is and do it. Next time don't wait until someone is "4 months" behind, and change the name on the utilities the minute someone moves in.
P.S. Self -help eviction is illegal in every state. If you kick her out or turn off her utilities, she will sue you AND you could be arrested.
My guess is that she has been "paying" rent ... just not with cash. No one lets their ex live for free for four freaking months and leaves their name on the utilities otherwise. |

depending on ur state, u need to serve her with a 3day pay or quit notice, then if she doens tpay in 3 days, serve her with a 3- days eviction notice. take the 30 day paper to court (copy) use to file a court date, they court will serve her with the paper work, bring all documentation, she should be gone in about 2 months for non payment or less. but u have no right to change locks or otherwise just bc she has no lease. |

What a sticky situation! Since it was a verbal agreement, it's he said, she said. However, there are available options and I'd assume that since she's not keeping up with the utilities, that would be a good basis for eviction. I've included links below to three sites I found. He must go through the legal hoops with her like any other tenant. Was there ANY agreement for her to pay anything?
If it was me (the husband) I'd say "Look, baby, I'm going to have to go to court and evict you and by then you'll owe six months rent and utilities. The witch I'm married to now (yes, I'd call you that for strategic purposes) is going to insist that I get a judgement for all the rent and utilities and file it and garnish your paychecks, tax refunds confiscate your car and anything else to get the money. I've been able to convince her to just let it go if you're out thirty days." Then I'd hand her Thirty Day Notice to Quit. "If you're not out by then, I'll see you in court. |

you have to write up an eviction notice (even if there is no lease agreement, do it to cover your own butt) and give her so much time (even if it's only a few days) and then kick her out! |
