get ur self a real estate attorney and do everthing by the book. they can find out everything u need to know and tell u exactly how to go about taking care of things.
u can probably find out at city hall, but a lawyer can do it all legally and without any flack from any one. |

Unless the house is his he can't sell it. You will need a probate attorney. If it is in his name he can call a title company and pay for a title report and that will give you all the liens on the property. |

Have someone, an attorney or title company, do a title search on the property if there are no liens on it deed it out of her estate, if you can legally, and record it. If your husband has already cleared the house through probate, then have it put in his name asap. If it has not cleared probate, then he will have to wait as the purpose of probating a will is to give creditors an opportunity to be paid. Generally, if it is credit cards or installment accounts on furniture, and even autos, they want bother. Check with the attorney who handled the estate or if there is none, talk with an attorney. |

There are actually two ways to do this.. You can go to the tax office and dig through all the paper work on the home and still possibly miss something, because like the rude person above said The records are public information.
Or you can get a title company to do a Guaranteed title search for $150.00 up to $200.00. They will check all the records and tell you if there is anything (i.e. personal loans, business loans, judgements, tax liens, etc...) on the home. After having this done they will guarantee there are no leans or loans etc. and if you sell the home and a lien does happen to pop up the title company will be responsable to pay it.

call your local government office and be put Thur to the tax division or assessors office- ask if any liens show- quick and easy. Its public information so you can get a copy of anything. You certainly don't ned a real estate agent to do this. |

There should be titles to the house and your mum should have a copy and so would the title deeds office.Your mum would have made her wishes known on her will. |

Get yourself an agent! Do not even think about selling without one.
Your agent will get preliminary Title report on the property even before you put the house for sale. When the actual sale takes place, the Title Company will do complete Title search.
Anyway, why ask an important question like this on Yahoo and not ask a professional agent?
