My landlord came and told me i have 5 days to get out. help!!!!?
he came with this guy and the landlord said i sold the house to this guy. the guy said u have 5 days to get out or the sheriffs will come. they didnt give me any paperwork or nothing. i havent paid rent because the house is getting foreclosed and they havent tried to contact us. and their phone is turned off so i cant contact them. is this legal??

Its legal but you are not getting thrown out in 5 days, they seem to be stating that they will start the eviction process in 5 days and after that runs thru you will get tossed, but that process runs 30 days minimum and can run 6 months some places (but figure 45-75 days is typical). So, you may want to start looking for a new place now, you will get evicted eventually but it won't be in 5 days (saying you have 5 days to leave doesn't or the sheriff will come does not mean the sheriff will come on the 6th day - and he won't).

you need to urgently get legal advise. anyone in your town or anyone. it is probably not legal but it depends on our rental agreement but you still have rights. please ring a lawyer x

No matter what legalities the homeowner is under, you have a contractual obligation to pay rent. you know where, who, and how you were getting your rent to them before. that is what's going to hurt you.
as someone above said, "The process starts in five days and runs thru 30 or 45 days." depending on where you are. On day 5 is when you will probably get your eviction notice to be out in 30 days.

In CA they have to give you 30 to 60 days to get out depending on how long you have rented the house.

If you haven't paid rent then maybe they don't have to give you any more than 5 days to get out. It can be considered grounds for eviction.

I don't know where you live, but you can google tenancy laws for your state, call a real estate agent, a lawyer or a property management agent. Maybe they could give you more help.

Unless you are behind on rent you get 30 days not 5 and a sheriff won't get involved unless your still there after the 30 days

Memo to Zinky

When a landlord sells his property to another person, the buyer has the option to pick up the lease with the terms as is, renegotiate a new lease with the existing tenant, or evict the the existing tenant.

I'm in escrow on a rental condo that has lease tenants. According to my real estate agent, I am under absolutely no binding obligation to any lease the tenant has with the previous owner.

Call the mayor's office and ask for the phone number of the department that deals with landlord/tenant issues. There is due process, but I don't know enough about the entire situation or where you are, and I'm not a lawyer.

Why weren't you paying rent? You may have hurt yourself by doing that. You still owed them the money whether they were being foreclosed or not.

Without paperwork you have no idea exactly whats happening, so ring the sheriffs office and ask. If they are coming, they have to have the paperwork.

No, especially if you have a child. Contact your local Legal Aid Society for assistance, they can point you in the right direction to get help
