My landlord did not return the security deposit? 10 points for the best advice. Thank you?
I moved out 2 months ago because she broke a verbal agreement.

She only own me $150. I don't need the money, but I hate to see she gets away of lying and taking advantage from me and possibly others.

The day I left Dec 2, she claimed she will mail the money to me on Jan 2.

I called her on Jan 5. She said, she will mail the money within this month.

I have been called her a few times this week, but she did not answer her phone.

I left her message --she must contact me. I have not heard from her.

A lawyer might be able to help. A lot will depend on if there is anything in writing. Verbal agreements, unfortunately, are as solid as the air they are written on. The problem with verbal agreements is that there is no way to prove them. The only possibility is if you have some witnesses to the conversation.

Verbal agreements are not binding in real estate. You need to rely on what you have in writing. If you moved out w/o giving her a 30 day notice, or before your lease matured then you forfeited the deposit.

150? I would not call pocket change "taking advantage". 150 doesn't go very far.

Did you talk to her about it to find out why she didn't give it back? She may have just forgotten, or she may have a reason, you need to bring it up with her and see what is going on first. So if there is a misunderstanding it can be resolved.

Review your contract. Did you ask her for the money back?

Normally you can't get the deposit back unless you fulfill your lease agreement. This also usually includes a written notice before termination of the lease.

BUT, if verbal agreements hold up where you live, then you could get it back. However, that's not likely. Not having something on paper usually doesn't get you anywhere.

I would just ask and explain why you moved out and see if she'll be nice about it. It's worth a shot.

Did your landlord send you a letter stating what your deposit was used for IE: Carpets cleaned,cleaning apartment, damages. If she did not send you this letter then you are indeed owed the money. Of course you do not mention what state you live in. But you can look up tenant laws on the Google. See what code she has broken.....

Hate to say it but if she just says no you don't get it back. all you can do is file a complaint with your local housing authority. It will cost you more time and money to chase her.

landlord has so many days to return the security deposit or send you a return of security deposit form showing the money you owe her or she owes you. If you changed address then you should have gotten this. In my state law is 21 days to receive deposit or notice why u didn't get deposit.
If you didn't change address then she probably sent the form to her old address and has fulfilled her obligation because you didn't give her a forwarding address. How ever if you gave her a forwarding address then you should have gotten paperwork .
If you have 150 dollars and gave her apt back in same shape you got it then you are able to get the deposit back in small claims court. My state gives double damages to tenants that don't receive a return of security notice on time. The condition report on apt would be important to have. did landlord give you a walk through after you vacated to see damages or ect?
Did you ever sign a condition report when u moved into apt? If not then landlord has no way to prove damages she charged you for were not there before you moved in! digital camera photos help if you have them to prove u left apt clean when you moved out. If you don't have photos this case is up in the air and it depends on the judges mood. most judges want to see proof of damages. Pictures and condition reports.
If you left it clean and have pics or ect to prove it then you can get deposit back. Also You have to by state law give notice in writing 30 days before you move out of a apt to get deposit back! If you didn't give notice then the deposit is forfeited. These are all things to think about and I think its not worth chasing after personally. 150 bucks if you left the place spotless and did everything right that I suggested you could get back in court. It will cost 100 to file in small claims court to sue her.
A lawyer can tell you what your state laws are cause they vary in every state. Is it worth a lawyer i would say no.
The internet search on your states landlord tenant rights will help if you want to follow up on your own. If you are a bull dog and really want to get back at this landlord then go for it get your money back! Hopefully you gave her a clean apt and a 30 day notice in writing with records of rents paid and return of address. If you did this you have a really strong case!
Prevailing plaintiff in court can receive court costs too as part of judgment!

It may differ by state, but here in Wisconsin she should have given it to you already or an itemized receipt of why she kept it... so i think depending on your state, she probably is breaking the law.. unless you had a verbal lease...than she might be able to slide passed it....good luck! :)

EDIT: If she said she was going to give it to you and she hasnt, I would call her one last time and warn her that if she doesnt come in contact with you and give you the money you will take legal action... I had this problem also, except it was $2000.00... She was going to keep it for cleaning expenses so i told her that i brought my video camera through the house before i left and that i would see her in court... I had that money, in full.. REAL quick after that!

Step 1
Just send her a demand letter and tell her by law, she is required to return deposits within 30 days after the lease is terminated, also remind her that the deadline was actually past due,and she is supposed to send you the fund ( deposits+ interest) right away, but you will give her another 10 days, specify a date and then send it by confirm tracking delivery.
Step 2
After the deadline, if she still have not do anything, go to the
small claim court, file a claim which should included your $150.+interest+court fees and then tell the judge why you think she owe money and show all your doc and letters to the judge.
Housing authority usually does not got involve with this kind of case. Small claim should be the way to get your judgment.

You would need to take her to court to enforce getting the deposit back. The exact amount of time she has to return the security deposit depends one where you live.

Here in PA, I have 30 days to return the security deposit or provide a written explanation as to what the deposit was used for. If I don't, i can be sued for twice the amount of the security deposit.

One thing, you say you moved out because of a broken verbal agreement. Hopefully you didn't leave in the middle of the lease. If you did, you might be liable for rent payments until the landlord re-rents the apartment, r the end of the lease term , whichever comes first. If you are completely sure that you didn't break a written lease then go for it and sue the landlord.
