any3 | My landlord doesn't respond to an inquiry about late fees. What can be done? |
Over a year ago late fees began accruing on my rent bill. I called the property manager on several occasions to inquire but got no response. Unsure of their validity and being unable to reach the manager I did not pay the late charges. The charges accrued for several months then stopped. After a six month hiatus late fees have begun to accrue again this month (January 2007). I've tried to contact the manager several times via telephone and twice via certified letter yet still have had no response. I continue to pay my rent on time but have not paid the late fees, which at this point are several hundred dollars. What is my recourse/exposure? |

Look in your lease for late fees. It has to be in there for them to charge them. IF it's in the lease, you agreed to it and owe them. IF it's not in the lease or seems usurious, then you could file a complaint (landlord-tenant authorities of some sort out there--I have no idea where you live). I'd keep the certified RETURN RECEIPT surely letter you sent to show you tried to contact the landlord.
This is likely to become an issue so find out what authorities handle this (if nothing else call your reference librarian). You may end up in small claims over this. |

call your local Landlord-Tenant Housing Service Office. they will help you. Make sure you keep copies of everything you communicate with your landlord - always do everything in writing. |

there are different laws depending on your county. search for you county's government website on google and look for landlord/tenant rights. everything will be spelled out there. they also have numbers you can call/addresses you can write to (email and snail mail) if your question isn't answered on the website.

Document every call, time and date, or times attempting to reach the property manager. If at this point you don't have that information from last year, fabricate (dishonest I know but you know you called, just don't remember the dates). Send them a dispute in writing, certified mail, and include the documented attempts at contact. Don't pay it and when or if you decide to move, advise them that they did not respond to your inquiries and the dispute has not been resolved. If they decide to take you to court (which I doubt they will because I can't imagine that the amount of late fees would exceed court costs), you'll have your evidence of dispute. If they do not take you to court, demand in writing full pardon of the late fees so that if they "slip" when giving references to your future landlord and/or creditors, you will have it in writing that you alleviated of those obligations. Good luck! Landlord's can be scandalous but not all of them (I used to be one). |

well the only thing I can think of is- put money away in savings for the late fees- since you know that you owe a substantial amount. But i am wondering why the landlord hasn't responded to your request- does he/she mail you a receipt when they receive rent from you? weather you pay by check/money order or any source I would still be wanting to have receipts sent. I do think its odd that he/she hasn't returned your inquiry's- I would just keep trying to get hold of the landlord. Heres one way that's kind of risky- don't pay your rent for a month- maybe then you may hear from the landlord. if not then something doesn't seem right. |

once you are paying your rent at proper time,you dont need to pay late fee.but make sure you keep all your canceled check copies with you to show him or in the court in case he take you to court. |

Go visit your landlord in person. Get everything he says in writing. If you have more problems, consider legal action and bring all your bills. |

Send him a certified letter disputing the late charges. Ask for a response within several days. I hope you have copies of your rent payments. If you need to go to court over this, you will need them to prove your case. This can become a bigger issue for you. You want to try to resolve this before you move. You don't want owe these fees when it is time for you to move!
I lived in a large apartment complex years ago. There were late charge errors like that on my bill every month. They kept telling me it was a system error and to disregard it. I demanded they put that in writing, and all of a sudden, the errors stopped.
