Trouble
|
It really depends on your state's landlord tenant laws, since the laws on the landlord's right to entry varies.
Generally, the landlord can legally keep a key to the rental in case of emergency or the tenant locks themselves out.
Generally, the landlord can enter in case of emergency or to preserve his property, without prior notice.
Generally, 24 hours prior notice is required for the landlord to enter for inspections or to make repairs.
Generally, tenants cannot unreasonably withhold consent for the landlord to enter and are not required to be present in order for the landlord to enter. |

Contrary to what others have posted...not all states require a notice to enter. If your state does have notice requirement, you can not deny entry nor do you need to be there. You need to check out your local laws. |

Technically No he can't however being its your in laws that's a whole new ball game since your husband probably isn't going to tell his parents to stay out. |

Yours is going to be a difficult situation because your landlord is also your husands father. A landlord by law must give 24 hours notice before he can enter and you can't stop them from doing so. If you don't want them in there, you'll need to arrange to be there. |

IM JUST GOING TO SAY HELL NO BUT YES THEY DO YOU KINDA HAVE THEM PERMISSION WHEN YOU SIGHTED THE LEASE YOU ARE RENTING BUT YET AND STILL THEY ARE THE OWNER AND BY LAW THAT STANDS THERE ARE STANDARDS THOUGH THEY NEED TO BE COMING IN FOR A REASON LIKE A WORK ORDER FIXING OF SOMETHING IN THE APARTMENT YOU ARE BEING EVICTED SOMETHING LIKE THAT BUT THEY CANT JUST COME IN WHEN YOUR HOME WHY NO TH ATS NOT RIGHT. If you signed a contract when you decide to rent the house or you had a verbal agreement on what would be done with the house
I would ask him ......he might be keeping it in case something happens
but if you do have a written agreement that says he can come in at anytime ....then yes legally he can |

This is a difficult situation because it's renting from a family member. You would need to check out your state specific, however generalized rule, lease or not is 24 hr notice, at which time a landlord must state why they need to enter the property. |

With 24 hrs notice

200% no.
there is a law on this.
he must give a written notice 48 hours before he wants to
visit or repair something;...........unless it is an emergency repair.
then he can come in right away. And if you feel he is
misusing the word emergency, you can sue him or
leave for breach of the lease.

In California, No. He needs to give 48 hours written notice to enter, unless it's an emergency like the roof caved in or the water pipes burst, but then only to contain the damage. I do believe there are similar laws in each state, but do check with the rental board.
Of course, if it's family it's a little more delicate in trying to enforce the law on the parents, especially if there is no written rental/lease agreement in place.
This is something you will need to discuss with your husband and then with his parents. You can explain that you would feel uncomfortable if his dad just walked in and you were just getting out of the shower, or ask that both of them visit the house if there is a need. If the rent is much (and I do mean much) lower than what you would otherwise pay, you may have to live with the fact that dad can just walk in (even after talking to them), especially if you are saving up for your own house. If rent is about the same, then consider if this is something you want to live with.
Best of luck to you! |
