I work for one of the major real estate franchises in Australia. I am not a property manager...however I have seen that the rule generally is that the owner has the option to raise the rent and if the tenant is unhappy with this the tenant has the option to move out. But they must by law give you 64 days notice before they raise the rent. By law you must give 21 days notice to the agent if your lease has expired and you must give 14 days notice if you have a current lease...always keep the copy of your lease in a safe place! To a large extent the agents act at the direction of the owner...so if you happen to have a greedy owner the agent will carry out their requests by raising the rent. Unfortunately the current rental market is very expensive and once owners and agents realise there is money to be made from making their properties a similar price to the higher example out there, and people looking to rent agree to pay those prices, then that determines the general prices. Note: if you decide to "break" your lease by moving out before it has expired...you may be charged fees and charges for the inconvenience it causes the agent and/or owner to find a new tenant. The good news is that there is community housing available if you wait on a list for a bit...this is a brilliant arrangement as the quality of the properties is very nice and the cost is actually cheaper than housing comission...(housing comission people pay 30% of thier income...I think com.housing is 25%) also no-one will know that the property is not privately leased as they are not in blocks or groups of houses. Assuming your lease is still valid, you cannot be evicted if your landlord altered the rent in the middle of your tenancy. He must wait until the lease on paper is complete to increase or decrease your rent. Doing so before is a breach of contract and you can take him to court.

in australia the law is the owner must give you 60 days notice in writing with the effective date of the increase to commence after the end of the lease date. If you do not feel that the rent increase is fair then first of all i would speak to your agent and see if this is negotiable, if it isnt then you would need to submit a written application to the department of fair trading to dispute the increased amount. The cost of this is approx $20. You will then both receive a letter from the tribunal with the hearing date set out and it will be decided upon by the registrar and you will be both given an opportnity to put your case forward.
if you didnt follow this process and you decided not to pay the difference then yes you would evenutally be evicted based on rental arrears.

You CAN ask the government body to review the rent increase, to see if it is justifiable. In Australia, we have the REIV. Usually you can win the case:
1. If your landlord had removed some benefits in your place (electrical appliances, utilities and their bills)
2. If your landlord did not add some benefits in your place to justify the rent increase.
My landlord increases my rent recently and I bring it to REIV. I won the case because the rent increase was not justified by my landlord. There was no benefit installed at the property.
Like everyone replied here, do it fast. Contact the necessary department ASAP.

No,NO,No, this is a breach of contract, it is unconscionable and unreasonable or excessive and not enforceable. If the moron try to force you, get back to Y/A you'll get help with just what you can do. Good Luck.

well first off if ur lease is not up then he just cant change the price a lease is like a contract once signed it cant be changed i would deffinately talk to someone about it they also have a number where you can call and get help bith bad landlords find out from your local court house

First off, read your rental agreement. Are you on a lease or a month to month? If you are on a lease, then they must wait until 30 days prior to your lease being up, if you are on a month to month then all they have to give you is a 30 day notice of intent! That's is the price we pay when we are renters! Call your local housing authority where you live and find out the local laws.

If you are in aust, the landlord is only allowed to increase your rent once every 6 months. We just left a property because our rent was increased but we wern't allowed to use the 4 car garage or the garden shed. You can take the matter to the ombusman, there should be info on the notice of increase in rent. I think they only give you 30 days to have the case reviewed so you must be quick.

Where are you - which country?

You need to act quickly - today - and get some advice.

There will be Government and probably community orgnaisation you can seek help from.

To begin - ring your local member of parliament and ask where to call. If you do not know who your local member is you can call Parliament House - or what ever it is in your country, and ask.

Other than that - the local town hall in whatever country you are in should be able to provide advice as to who to call, but you must do it IMMEDIATELY.

In our country in the State I live in - no, you cannot double the rent laid down in writing.
