My landlord has refused to fix or clean up after sewage spills in basment for 9 mths he blames us says it's my?
we have had repeated sewage spills in our basment in pa. we recently found out it's because he hooked the sump pump in to the sanitary sewer line and every time it rains hard It blows sewage all over the basement, we have been sick for months and lost a lot of work it's me my wife and daughter, all are sick 3 or 4 times a month, throwing up stomach pains ect. we hade the township inspect and it is illegal to hook the sump pump like this, now we are getting evicted because we turned him in can we sue for our health issues or lost wages?

a little more information, we did take pictures and documentation, we didn't know it was sewage untill recently, I mean it did smell but it was mixed with the rain water from the sump pump. every time we called the landlord and e-mailed hi he said it was our fault, and it was our problem. we finaly contacted the township and they cited him. he still hasn't fixed it but filed for eviction. not sure what's going to happen there. but we can't afford an attorney to fight him which has been the problem all along. some how it dosen't seem right. we've missed a lot of work from being sick. he will walk in our door with out knocking, he has told my wife she was only allowed to use 2 squares of toliet paper, I just found that out, she knew i would go postal on him. for all of you who say it my fault had i known it was sewage in the water i would have called for the inspection sooner. it took so long to find the right sewer athourity.

Your landlord has no legal right to force you to vacate as long as your rent is paid to date. He has no legal right to enter the residence without knocking (buy a chain lock). He has no right to tell your wife how much toilet paper to use.

Your landlord has a legal obligation to fix any problem that creates a health hazard for the renters.

If you can't afford to move then don't move. Let him file formal eviction papers and go to court. Then you can tell the judge about the citation and he will be forced to fix the problem. Then I would file for damages in small claims court using your pictures and his citation as back for your claim.

Yes, definately. You can sue for all of those and also for suffering too if it can be proved that you were infected because of his faulty plumbing.
It is not your fault you unwittingly moved into a rented residence that had no suitable sewerage disposal.
If you really wish to stay there then you could be volunteering to expose yourself to these dangers and reduce any claim.
Seek legal advice.

I wish I could find a renter in Atlanta to not rip apart walls, or stuff
stuff down the toilet however you probally can sew, he was not even
suppose to be renting a house if it was not up to city code because when we rented one it had to be up to city code.

You do not need to be living in that house it should have be condem,
take photos or viedo before you sue because your going need
proof. And your proof should have been in wrighting from the township.

idunno about laws in PA, but in ohio there's something you can do. check with your local clerk of courts office and find the division of public housing.

you can file a grievance and put your money in escrow. the courts collect your monthly rent and tell your landlord he/she won't see a dime of it until everything is fixed to your aproval and the courts aproval.

he cannot evict you or cause you problems because of it. so try that option.

Dont know if you live in the UK but he wont have a leg to stand on.

Start to take photos and make a log of everything.

Everytime its there,photo and log it,mention illness etc.

You should contact Enviromental Health.
Contact the newspapers,
Contact Citizens advice for free legal help.

at the end of the day,him doing a shortcut is and has cost you your home,your health and your wages.
Someone is liable and its not you.

But i would recommend contaction a local or nation newspaper and ask them if they want to take up the story of a landlord Evicting a family and children because of what he has done.

As for the comment by reenzz.
you say that you could not move anywhere esle as you have no money and the landlord would have refused give you your deposit and rent advance back

Why the H-E-double-L would you want to stay? As soon as I found that he "hooked the sump pump in to the sanitary sewer line" I would have packed up and left and sued him for moving expenses.

You can indeed sue for illegal eviction You should consult with an attorney as to the medical. You may also have moving and other charges you can recoup.

I am a property mgr., in another state.
It is his responsibility.
You don't have to have an attorney; use all your evidence and file it with the court.
(this is what an attorney is for, they know what papers, requests to file)
You want to answer, a request for eviction.
Request the judge for restitution for lost wages, etc...
bring the proof of payment and visits to the Dr.'s office.
What ever you ask for;
you have to show that it was his responsibility, negligence, etc...

Why on earth did you stay is such conditions for 9 months...putting your family's heath at risk?

That is the question any judge would ask you if you do decide to sue, so you had better have a good answer.

You can definitely sue. Just find a non-sleazy lawyer.

Make sure before you get evicted to consult a lawyer. Before you leave your going to have to take pictures, maybe take a sewage sample.

Definitely make sure to get all this done before you leave.

Fix it and send him the bill. Or move out.

Why anyone would raise a child in that type of environment for 9 months is beyond me. The landlord could probably turn you into social services for allowing a child to live like that. I highly doubt you have a case if you haven't done anything about it for that long.
