My landlord, who lives a few miles from me, is now demanding I mail my rent payment to her. I did have a returned check last month, so now she will only accept certified funds. In that instance, I wrote her the check on the 1st (I don't have any grace period), and she tried to cash it on the 2nd. My deposit didn't post until midnight on the 2nd and I didn't realize she would try to cash it instead of deposit it. It would have cleared if that had been the case. She charged me a $115 late fee and $35 returned check fee, and I dealt with it. But now she is saying she has to receive all future payments by mail ONLY by the 1st of each month. If she doesn't receive it I am responsible for late fees. What if the 1st is a holiday or Sunday? Basically, she's saying I have to pay it early if that's the case. Can she do that? I thought she had to provide a secure place for me to drop off my rent. My lease doesn't say mail, just that it must be received at her address. |

She can demand mail. This will protect both of you. She will have a post dated envelope showing when you paid the rent.
You broker the lease with the bad check, so she is simply trying to cover herself in case you do it again. This will also protect you from any late fees, as the mail is dated when you send it, not when she receives it. Since you are in town delivery should never be more then 48 hours, usually 24. |

The landlord is changing the terms of your rental agreement. Yes, she can do that by giving you 30 days notice if you are month to month. Otherwise, if you are on a longer lease still in effect, any changes in the terms have to be mutually agreed to. Once the lease expires you are month to month unless you both renew the lease for a specified term. If the lease is silent as to how the rent is to be paid, but specifies the date, like the first, then you can get it to her by any reasonable means before or on the first, but it should be there on the first, not mailed on the first, and the funds should be good on the first. |

What does your lease say about being late? How late is late?
What you signed is all that's legal.
She can ask anything she wants in as loud a voice as she wants - but all that matters is what the lease says.
Tell her you'll go by the terms of the lease and that you are sorry for last month, but that you've been a great tenant and want to keep being a great tenant for a long time.

1. Check your lease. What does it say about late charges? She cannot simply charge what she wants. It must be spelled out in the lease.
2. Can she refuse a check and demand certified funds? Possibly, depending upon the state you are in. Remember that SHE was undoubtedly charged a return check fee from her bank (some banks charge a LOT for this) so she has the right to pass that cost along to you.
3. Can she evict you for missing payment on the 1st? No. In fact, in most states, the eviction time can be lengthy, as long as 6 months if you put up a fight.
4. Can she change the terms of the lease? Yes, if you are on a month to month contract. If you have a set term, she must honor the terms the same as you. |

You don't say what state you live in and that is crucial to giving a correct answer.
I am a landlord in IL and in IL by statute the landlord must give the tenant a 5 day grace period. So my leases state that rent is DUE on the 1st and LATE on the 6th, so if you paid by the 5th your rent is "on time" |

The written lease is what matters. If it says you can deliver it to her house, you can. But make sure you hand it to her personally so she can't claim nonreceipt. |

Under californias "bad check" law, she can only charge you a maximum of 25 dollars for a returned check for the first time and 35 dollars the second time. The late fee must also be reasonable to the damages that the landlord faced for having a late payment. tell your landlord you would prefer to pay her direct debit to her account,,,if she wont go for that send them the payment,1 or 2 days earlier,,sounds like you are going to have dramas with her,,,she is scamming you so she can charge you extra fees,,,,,, another idea is to give her a money/order that way she has no excuse for not getting paid on time,,and cant charge you fees,,,personally when the lease is up ,,move out,,she gonna cause you dramas,,hoped this help,, |

Well,if you get your check on a holiday,it should be there before the holiday,like Christmas falls on the 25th of Tuesday,so the 1st will be a holiday,so your check will be there on December 29th,it should be anyway,and yes if she's a ***** like that she can can,i personally would let it slide a couple days,but thats me.Just tell her that it's going to be imposible and it's gonna be a day or two late,she cant throw you out,and she'll need a real good reason to evict you,a couple days late on the rent aint gonna get it in front of a judge,so *** her dont worry about it. |
