My landlord is doing a walkthrough for the first time in 2 years?
and I am not sure why. I am worried about being evicted. The house is in good shape other than the basement. It started flooding within a month or two after we moved in. It it finished and it has been flooding pretty bad. We told the landlord about several times and he said that it only flooded because the gutters weren't cleaned out but we have found that the foundation is cracked. The carpet is really stained bad from the flooding. Can they evict use because of this? What are my rights as a renter?

First take a picture of the cracked foundation if it is indeed the reason you get water damage.
From now on if you want anything done or replaced by the landlord, write a letter, make a copy of that letter and send it certified mail so that there is proof that they got it ( they have to sign for it ).Add an envelope with a stamp on it so they can respond.
You need to protect yourself and incase you ever are brought to court you will have proof . Most judges side with the tenant.
You are not resposible for cracked foundations.

Clean the place up and offer him a coffee. He is perfectly within his rights to inspect periodically.

Do you have renters insurance? In any case your landlord is responsible for fixing that stuff, your basement flooding can be unhealthy for you and your family. Even if he is not evicting you I would get on him to fix it its his responsibility :)

No, flooding is not your fault. Who is supposed to clean gutters according to lease--you or LL? Make sure they're cleaned before he comes if it's your job.
Hopefully you put requests for LL to address basement issues in writing.
Be welcoming, and tell him you're glad he's coming to address basement problem. Show him the cracks and tell him that you have seen seepage through them numerous times--whatever.
Presumably you have little or nothing in basement due to problem?

That's not your fault and you told the landlord about it so he can't hold it against you. It's his responsibility to fix things that are broken and to maintain the property which he has failed to do.

you wont be evicted becausethat'ss your land lords problem. you have told him so many times. my mom and dad rent a place out and when somthing needs to get done they call and my dad goes over and fixes it and tthat'swhat a land lord does and if its not your fault because of the way the house is then don;t worrie about it

You should submit all complaints to the landlord in writing and keep copies.He will be doing the walk through to ascertain what the damage s/state is and what he has to do and what he can get away with.Make sure it is clean and you repair any damage you have caused.You should have a rent book by law and this gives you certain rights in law to protect your interests,you should never rent without knowing the law on it.The public health department may be interested in the effects of the flooding.He is probably walking in to see what he has to do about it.

Always communicate in writing and document everything. You should never have allowed the flooding to go on this long, the landlord should have fixed it way before. He says it's because of the gutters, you say it's because of the foundation. What proof do you have to back up your side? They could possibly attempt to evict, but there is really not enough information for me to know if they will. Two years is a long time for an issue not to be resolved, and your previous communications regarding this will really affect what happens next. Bottom line, if he tries to evict you, you can fight it but you'd better be able to prove up your side of the story.

RELAX! They are not hunting for reasons to evict you. It is standard for landlords to do a walk thru on long term tenants. They just want to see if anything needs fixed. I don't think the carpet will be a big problem since you already told them about it. In fact they may be coming to look at what it will take to fix that.

Did you make your complaints in written form and keep copies in case he does say the flooding is your fault? Are you required to clean out the gutters or is the landlord?

Sounds like he may be up to something.........

I think all owners/landlords should inspect quarterly but if he has not in 2 years and is all of the sudden.... hmm?

First when it flooded and you told the landlord you should have kept on top of it since you say there is a crack in the foundation that would need to be pointed out to the landlord otherwise they aren't going to know.

As for them serving you with a notice to move maybe so if the basement is as nasty as you say it is.
