yes, he can still have you evicted.

Of course you should pay your rent. If you are unsure who to give the rent check to then you should get a money order or check and send it certified mail to the address on your lease. That way when he does get out and gets his mail there will be no question if you paid it on time.

You're still on the hook for it, but take your time. What's he gonna do? The dumbass got himself in jail. As soon as he speaks up, pay him. Say sorry, it just slipped your mind. Far as I know, no landlord in America can legally throw you out without any warning. As soon as you get a warning, pay the man.

If you have an interest-bearing checking account, write the check today and record it in your check register so you don't spend the rent money, but don't deliver the check until he asks where the rent is. That way you'll still earn interest on your money until he speaks up. If he doesn't like it, screw him. He's the criminal, not you.
