My landlord is making me pay more than what my lease states?
The lease I signed is for 525 and because he states is wife made a mistake when drawing the lease I have to pay 550 even though the lease I signed stated 525 can he do that?

budhah1
Mistakes happen, and if you knew that it was to be $550 then you should pay that, and should have told her she made a mistake,,,

Now that being said The lease says $525 and that is all you legally owe, and can get by in court on that, but you know the real truth and it is up to you to be honest.. He may not rent to you next year,, I did that to a girl.. We agreed to raise her rent $25 a month in July in return for new fridge and Range, and after installing the units she refused to pay extra until the new lease in August... I Told her to find a new place...

Fair is Fair

No, you can fight this if you want. Unless he makes a new lease, you aren't responsible to pay anymore than what you signed for!

T-Nub
NO!!!!!!!! What ever the lease states is what you pay. Unless you agree to the incresase. You could take him to court if he insists that you pay.

Joe Joe's Mama
no he can't

No he can't!! You pay what's on the lease. Stand firm! Good luck!

verne d
your landlord can't make u pay no more then whats stated on the lease. He should of looked over the least before everything was drawed up, that's his wife's fault. Let her pay for her mistake!!! any court in america will say the same.

That was a unilateral mistake on his part. He cannot make you pay. If it had been a bilateral mistake, he could charge you for it.
If there is a misunderstanding in a contract, it is interpreted against the one who wrote it.

Rox R
take him to court..

Purple
Probably not. You could take him to small claims court.
That is fraud having you sign a lease with one amount and then changing it.

remowlms
Nope.

Not if they didn't fix it in the lease when you signed it, brought it to your attention, made a note of it, signed it and had you inital it.

However, if you knew that they wanted 550 when you signed it, that's what you should you pay.

If they told you after the fact, then no, they can't legally do that.

you're lucky I'm nice
the lease is a legally-binding agreement. that's what you pay. any court will uphold that.

ottertech42
No, the contract you signed is leagally binding. Depending on where you live, there may be a tenant's right organization, (at the very least there should be a state wide office.) Check with them to see what you rights are if he tries to force you to pay.

illegal...sorry. if it's not written in the lease then he can't make u pay more

Nope!! his loss -- The signed lease says $525 then that's what you pay. DON'T PAY ANYMORE!!!!

Nope- the lease is the lease, and that is what you signed- it's a legal document. Do not pay a penny over what you have signed that you have to pay- make sure that you always pay on time (or even early), and abide by all tennent requirements. The worse thing that the landlord can do is take you to court, and the judge will ask to see a copy of the lease, which will prove your side of the case. After you lease it up, I wouldn't re-sign with them, though.

Kick him in the crotch and then say "Yo! Sit your five dollar a s s down before I make change!" - This worked for me.

No he can not do that. He is binded by the lease as you are.

michelle b
I know there all type of loop holes in those contracts so read through it through and through. It may state that he can raise your rent for whatever reason. It also depends on the state you live in. You have to call your local housing dept and ask for numbers pertaining to the incident. Just describe to them what happened and they should be able to hook you up. In connecticut I would call the fair housing authority so if you have one of those call there directly.

krazyladee

No! Not unless he draws up a new lease, and he has to have a reason for the increase. Did he sign it also? Did he adjust the amounts as you signed? Take it to the housing authority.

TheAimer
NO WAY talk to housing court about this.

PurplePalooza
NO MA'AM!! He is wrong! You should not pay that. Pay what the lease says and if he evicts you, then you can take him to see Judge Judy.

I'm serious though! He is wrong. Your lease is a contract and he is breaking it.

onandonandonanon
NO that is ILLEGAL, tell him you are sorry his wife made the mistake, but a signed lease for the amount stated is what is legal that you aren't going to pay it and if wants to argue about it he can call your attorney! You may want to call an attorney's office and speak to him about it briefly so you can hand the landlord his number when you say that to him!! Be prepared to move when the lease is up!

llcentlous
only if he amends the lease and you sign for it... if you don't then he has to give you the rate he promised for however long the first lease is, then he can kick you out... take it to a lawyer

Gertie

no he cant do that you signed the lease for 525 not 550 if it was a mistake he should have noticed it while going over the lease with you before you signed and then he could have corrected it.

Nicole H
Rating
No he cant if the lease was signed by you at the price of 525 that is a very legal contract. Mistakes are irrelevent. I would difinitely fight that. Its like you not paying your rent and saying it was a mistake and him just being like okay thats fine and forgetting about it lol. Read over your lease if it says anything about him being able to change it at any time then hes got you stuck if not dont pay that extra money.

Sue B
Rating
NO they cant do that, if all paperwork is signed and that is what you have been paying, they cant change it now, they will just have to catch you on the next lease renewal.

«Charmer»
Rating
Nope, you can bring him to court too.
If it's in the lease, he can't change it unless he creates a new lease and has you sign it, or unless there is some loophole in the lease.
Tell him no, you wont pay, bring him to court.
He can't evict you for that either.

The Great Gazoo
Rating
no he cannot the only way he can do that is to make up a new lease and have you sign it. your lease should be good for a year. Don;t pay thye extra and if he tries to evict you sue him. make sure you have receiptes showing you have paid $550

Vegito
no he should have his wife re-type the document and then have you sign it. You should consult a lawyer.

designated_dave_the_punk
No, absolutely not! Every state has a Tenant Handbook. I am from kansas, so it's the Kansas Tenant Handbook. It has all the laws, rules, and policies, as well as other things you need to know about renting. Find yours. You could even bring a lawsuit against your landlord. What he is doing is illegal. If it was a mistake that was done, than he, as a landlord and a business man, needs to get it together and have it fixed before ANYONE signs the dotted line.
