My landlord is taking my whole security deposit and won't give it back because my dog damaged the carpet?
so my dog dug a hole in the carpet and she had berber carpet. i told her i'll pay for it and its fine but now she is charging 1200 for changing the carpet to hardwood floors because as she stated "the new carpet would not match the old carpet" and so i send a letter demanding that she pays me back the difference but she wrote back basically saying that I was the one who caused her monetary loss because she couldn't rent the house out in time and so she lost a whole month's rent. I called her numerous time (5+) in the past month and she never discussed with me the cost of this. She just kept telling me to give her more time. She finally send me an invoice one month later (well past the 21 days as required by CA law) that says she is keeping the whole deposit ($2000) for extra damages to the house and for cleaning costs. What can I do ?
I am not saying that I won't pay for it because my dog did damage the carpet I just want her to be reasonable.

again, I am not asking for the whole security deposit back. I just want her to be fair. and plus it was not a hole...i should have worded my words carefully...the carpet got caught on my dog's nails (my fault for not cutting it) and he pulled out a piece of it about yay big -----------------------
seriously its about that big. and she NEVER informed me of any thing no matter how many times I called her and plus now I think she wants to sue me because she took a whole month's time to fix the carpet and in her opinion she lost a whole month's rent.

Ok, you have a lot of answers so far, but here's a straightforward one.

1) The landlord sent you the invoice *after* the legal period. Based on that alone, you may be entitled to your entire deposit back. A judge would probably look at all the facts in the case if you sued and would probably not get it all back, but on this technicality alone, you win.

2) Assuming you don't win on #1, then the landlord can only charge you for replacing the carpet and the actual cost of the exact same carpet. In addition, they can only charge a pro-rated cost. So for carpet, it's a 10-year lifespan. If it was 5 years old (and you can prove that) then they can only charge you for 50% of the carpet replacement cost. In addition, they can only charge for the replacement cost of the room the damage was in, not for the whole house.

3) The landlord, under NO conditions can ever charge you for an "upgrade" they do. In this case, they opted to go with hardwood floors which were more expensive than the carpet. This is NOT legal and if you have this anywhere in writing where the landlord said they're doing hardwood, keep that letter because a judge would be happy to see it.

4) Suing for lost rental time - If you stayed for the term of your lease, THAT is all you're required to pay. Any additional time is not your responsibility and therefore, you don't have to pay 1 cent. There are exceptions on if you caused incredible damage such as tearing down a wall or something and it requires more time to fix it. Replacing carpet is a quick fix and so it is not your responsibility for any lost income from rent.

5) The landlord must have received official estimates. If the landlord did not get official estimates to do the carpet replacement, then on this technicality, you may win and get your entire deposit back too.

6) Last but not least... you mentioned there were repairs that the landlord did not make within a reasonable period of time. Absolutely keep evidence of that to show a judge. They will rule against the landlord in a heartbeat if you can show they were negligent in taking care of you under the terms of normal Landlord-Tennant contracts (Thou Shalt Fix any Problems or else :) ).

How long did you live there? What year did you begin renting? If you were there long enough the carpets would have to be replaced anyway. Because they're notorious for scamming tenants, small claims court LOVES ruling against landlords - IF you have a case. I've won twice. Research the CA code online and if you think you have a case, file online also. It's only $30, and if you know you're right, it's a helluva lot fun!

If She paid out less than the deposit, You may have grounds for a law suit. Also, if she didn't get an estimate from a licensed contractor, and spent money on her own, even if it was more than the deposit, You might have grounds for a law suit. I would talk to a lawyer

It is customary for any carpeting replacement fees to be prorated. For example, the lifespan of carpet is about 10 years. Since the carpeting was 4 years old, you would be responsible for 60% of the cost and the landlord should pick up the 40%.

If your landlord wants to upgrade to hardwood, any extra costs should be out of her own pocket.

By not sendin the invoice within the 21 days required under CA law, she might not be able to withhold any amount from your security deposit. Also, even though - as you admit - your dog dug a hole in the carpet, there is no reason she would have to replace ALL the carpet in the apartment. There is no law saying all the carpet has to match - it just has to be up to a certain standard.

If you have documentation of her not fixing items in the past, such as copies of letters, etc., you should hang on to them.

I think you might get legal advice and go to small claims court. It sounds to me like, although there is legitimate damage, she has not done this within the law and she is trying to keep all the deposit unfairly.

Yes, if it was me....I would get two estimates...for the cost of replacing the Berber carpet. That is one estimate from one carpet store and another estimate from another carpet store.
Then, you would have the figures for a fair market value. Was there any damage to the hardwood floor? I would send her the two estimates in a registered letter. This will be a little foot work for you in the beginning but it will be well worth it in the end. $2,000 is a large chunk of change and you should be entitled to some of it and you will need some of it to get established in your new apartment. I hope this helps you and remember you have rights, too. If you have always paid your rent on time, are a quiet tenant, and are cooperative with her.....it seems like she would be willing to work with you on this? When a renter's pet damaged my furniture I kept half of the security deposit. That was a peaceful resolution for all of us. That particular tenant had done a lot to help with the house and yard work so I was grateful for her being so motivated.

You dog dug a HOLE in the carpet and you want your security deposit back??? Are you insane??? Berber carpet is not cheap and you can't "patch" carpet, the whole room needs to be replaced, and then you have to pay installation costs.

Every argument your landlord has is valid.

Take her to small claims court, present your case and let a judge decide. If she won't give you back what you feel is correct, that's the only thing you can do.

She is well within her right to keep the deposit... that's why a Landlord asks for a deposit. Pets cause a lot of damage and carpet cannot be replaced in "one spot" sometimes. I think that you just need to cut your losses and find another place to live if your relationship with your landlord is that bad.

Honestly, I think you are damn lucky she is not suing you for more then the 2k. This incident cost her a lot more then that.

She can change the carpeting in the whole house and you have to pay for it. It is going to cost closer to 7k.

She is doing you a favor switching to hardwood. You have nothing to be crying about. She is being more then reasonable, she is being very generous.
