My landlord is trying to raise my rent.....HELP!!!?
my lease isnt up until may 31, and then it goes month to month after that but i got a notice (an addendum) saying that i have 15 days to decide to renew my lease (in april) and the rent goes up $5 more a month or not sign it and the rent goes up $50 more a month (to $900!!!!)

ok, i got this notice recently and my lease isnt up for another 2 months. my lease does state the rent will be $800 but since i had my BF move in with me the rent was raised $50 so now its $850. but i was looking forward to the month to month option because then if i found another place to live that was better i am not stuck having to live here if i find something better. so if i decide not to sign the renewal aggrement can i move out now or have to wait until may 31st? if i do renew what would be the new date when my new lease will end and go month to month...

Your state's attorney general's office will have info on landlord tenant rights.

Your landlord gave you adequate notice to raise your rent. I am not certain, however, charging more rent for an additional tenant (your boyfriend) is legal under federal fair housing laws.

Before you sign any agreement, make sure you understand what your obligations are as well as those of your landlord's.

If you intend on moving, make sure you give the proper written notice that you are vacating.

what rights do you think you have?

You had an agreement with the landlord for 12 months to pay $850 a month. On May 31 the agreement ends. If you stay and don't sign a new lease, you then have a month to month agreement - which now has a NEW price of $900 a month.

The landlord is offering you a choice. Lock in the rent price for another year for only $5 more a month (GREAT DEAL), or have the freedom that a month to month lease gives you, but pay $50 more a month. OR move out.

The landlord is being VERY VERY fair.

Are you really complaining about a rent increase of $5? Sounds like a great deal to me, if you want to stay in that apartment.

If you go month to month, not only is the new rent $900, but next month he can raise it again, and the next and the next because you have no agreement that it will stay the same for any amount of time. Take the deal or move.

Unfortunately for you, that is a perfectly legitimate option for the landlord to offer you. Once your initial lease is up they have no obligation to keep your rent the same except in rent controlled areas.

I don't think glendale is rent controlled, but you should check just to be sure. Go to the city/county courthouse and ask there. They'll be able to tell you whether or not you're in a rent controlled area.

We all understand that you have a lease. No need to shout.

The landlord is completely within his rights to increase the rent. He is respecting your right to notice of the increase. You can now decide if you want either of the increases or if you wish to move out May 31st.

You have the right to decide this yourself, your landlord is not trying to force you to pay an increased rent, you have plenty of time to give him his 30 day notice if you are unhappy with the new rental arrangement.

Review your current lease. This seems pretty normal to me, most landlords require 30-60 written notice as to whether you'll be staying or not and usually the rent increases whether you sign a lease or not. due to the supposed risk of a tenant moving out at any time it's often much more expensive to rent month to month. look at your lease but it probably has this written out and the payment increase wouldn't take place until your current lease ended on may 31.

Well, he or she is landlord, then have all the rights to do this, Because your landlord didn't raise your rent during the contract. The landlords has the right to raise the rent at anytime they want and as much as they want if there is no contract involved.

You can not force your landlord to enter into a month to month lease with you at your same rental rate. Once your lease expires, all bets are off and it's time for negiotiations. You have a choice to either sign the renewal, pay the higher fee for a month to month, or move out.

Yes your landlord can raise your rent at the end of the lease term however, they must provide adequate notice that it is increasing, which he has done.

What they are charging you for, if you don't renew, is "Hold over" rent, you dont' renew you are holding over so the rent is usually a lot higher than if you sign a lease. Your options are don't renew and go month to month at the higher rent until you find something else, or don't renew and send the landlord a 60 day notice of non-renewal and vacate by no later than May 31st.

If you choose not to renew you are still obligated to pay rent thru May 31st even if you move out now. Technically you'd be breaking the lease if you vacated now and did not provide a minimum of 30 days written notice to vacate. Remember, you are not obligated to pay the increased rental rate until June 1, 2008.

Once your initial lease is up, your landlord can raise your rent. Until that time, you are only responsible for paying the rent that is stated in your lease. In many cases landlords will charge more on a month to month option then they will if you renew your lease for another year. For them it is about stability. If they know they will have a tenant for a full year they can charge less because they are assured a full 12 months of rent. If your initial lease requires 60 days notice to renew or terminate your lease at the end of the term the 15 day addendum you received to review is perfectly legal and actually a friendly reminder. You may want to ask your landlord if they mean that your rent will go up starting June 1. That is what seems likely to me. Also, I do not believe it is legal for your landlord to have raised your rent due to your boyfriend moving in. I have attached a link below with an overview of the CA landlord tenant laws.
