Most landlords have a right to do this during reasonable hours and reasonable notice. Check your lease. |

Unless your lease agreement specifically covers such a situation, it is governed by the laws of your state. California has some restrictions on such showings, but most states do not have them. In my state, all that is required to show a property (during reasonable hours) is a twelve hour advance notice that someone will show up.
As a real estate agent, we try to 'group showings' on certain days to minimize disruption to tenants, but she is under no obligation to do so. |

Having been in RE and also a landlord, I know how it SHOULD work. First and foremost, check your lease carefully. What does it say about the landlord coming into the home for repairs, for access and so on? If it is silent on landlord access, or agents of the landlord, check your local library on Tenant/Landlord Rights. Most states have laws regulating these leases. If the landlord has put something outlandish in, such as 24/7 access, it may be illegal or considered unreasonable. Most landlords have the right to show their property and sell it, even if you live there, but it comes down to how accommodating do you HAVE to be to help them? In my course of business, I always had access with what was can "Reasonable notice"-24 hours was considered sufficient to meet that requirement. Since I didn't want to accompany all the showings, I would want a lock box on, most tenants did not like that idea, but I usually would notify the tenant first that I was interested in selling it, planned to put it up for sale, ask for their cooperation, and in exchange, if the property was sold, with their cooperation in showings, I would make sure the lease was honored by the incoming owner-or I might offer a $1000 for them to move with a 60-90 notice-paid the day they vacated and left the premises in broom clean condition. I didn't expect them to be troubled for nothing, and once we knew we were on the same page, I got cooperation from the tenant. I asked the agents showing it to give reasonable notice in showing and to be careful of coming during tenants dinner time, or baby's naptime. Most tenants were helpful, but some were harder than others, those not wanting to move would want reassurance their rents would remain the same, or that they would have sufficient time to move. Your landlord is not really doing much talking to you, and I would say that is really not very nice, but not unusual. Maybe reminding them you have what is called "Quiet enjoyment" of the property you are renting is what you are paying for, not putting on a show for her and the Realtors. Its not fair to expect you to bend over, without giving something in return, like a little respect and concern for your well being too. Try and talk with her after finding out what your rights are and maybe having a half hour consultation with a lawyer specializing in tenant/landlord law. Might cost $50-100 to have a little chat and know where you stand, and well worth the money and then go from there. Good luck! |

Tell him if he wants your cooperation he better sit down with you and negotiate this. Don't forget the new buyer gets you for the balance of the lease and a lot can depend on if you are sweet or sour.
Points I would propose if I were you. Ask for a break on the rent. Offer it for Open House only once a month with provisions for entertaining your family on that day (pay for movies and lunch for all and things like that), NO lookie-loo window shoppers at other times (only pre-approved serious shoppers).
If the resist all reason say: "Good we can use those times to discuss all the 'issues' we have with the house, the neighborhood, the neighbors, local crime trends, scandals at the schools, etc., etc." |

No there isn't all they have to do is give you a 24 hour notice that they will be coming on a such and such day whether you are there or not. |

It is THEIR house and they have the right to show it. Just as the new owner will have the right to keep you as a tenant or not.
Normally, they give you advance notice that they are showing it. |

You should check with they city of the guidelines for landlords. Also read carefully your lease agreement. While you just signed a new one, chances are there is new verbage regarding this scenario than what was in the last one. |

The landlord is well within his rights to show HIS property. You need to check your local landlord/tenant laws to see if he needs to give a notice to enter...not all states require it. |
