My landlord refuses to accept my rent payment- she wants to evict us and has decided this is the way to do it-
we are in the middle of a lawsuit against her because her property we are renting is full of mold and she refuses to provide us with reasonable accomodations or fix the problem. Now that we have taken her to court she is refusing to accept payment- an easy way to get out of the problem is to get rid of us for non-payment. What can I do?

legally she has to serve you with a 3 day notice and a 30 day notice. You can go to the Federal building in your area and file papers which make it possible to stay, rent free, for about 6 months. You might check into a paralegal for this, they will fill out the papers, and tell you where to file them. Probably you can do it online these days. Then I would take pictures, of all the bad things you claim about the house. Collect all documents, like rental agreement, rent receipts, copy of the check she refused, etc. Build your case. Call Legal Aid, which in most states have free advice. Go from there. I would think you would want to move, mold is not cool at all.

You are in the middle of a lawsuit with your landlord. This tells me you have a lawyer working for you. What does she say?

By the way, your state has explicit laws for eviction, and your landlord must follow them to the T. That includes a notice to pay rent in 3 days, which is the first step. When you receive that notice, send your payment by certified & receipt mail, making copies of the check and the letter you enclosed.

Google up your state + "tenant rights" and learn about the eviction steps. Your landlord needs an education, as well.

But can you explain why you would WANT to pay rent in order to stay in a property that is "full of mold"?

Put the rent money into an escrow account. If this is going to court anyway the judge will want to know that you have the money in an escrow account. I don't know what area you live in but in most places it would be illegal to evict as retaliation for requesting repairs or taking an issue to court.

If you are paying late she can refuse it. If you are month-to-month and she gave you 30 days notice and you didn't leave she can refuse payment.

But in these cases - which are always take much longer than anyone plans - why do you stay in a place that is full of mold when you can easily leave and the landlord will be stuck with an unrentable place?

Why expose yourself and your family to what you seem to feel are unhealthy conditions when you can easily leave and sue for damages later?

If you have a witness with you...someone who can vouch that you attempted to pay her....but she refused payment...you have a way to fight her on grounds of non-payment.

Send your payment via certified mail, or better yet, through Fed Ex or UPS, with signature verification - sometimes they can refuse a certified mail, but don't put your names on the FED-EX or UPS envelope, use your moms address and sure as heck they will sign for it wondering what it is! Like Christmas - then you have signature proof that you sent it! (make sure only recipient named is only signer) Make sure you photocopy everything in the envelope, and if possible, make sure the person at UPS or FED_EX sees what you are putting inside or have a notary certify what is going into the envelope!
(Type up contents and have notary certify that she or he saw the contents placed in the envelope and the envelope either picked up or placed in the box in their presence -
Works every time!

Are you on a lease, or just month to month???
You need a lawyer.....If you can't afford one, look into any
Legal Aid places, or the phone book......or else look on line
for some......

Mail her the check via certified mail or use an escrow service. You need to have a way to verify that you attempted to pay her. Also, you need to bring this up in court.
