at any time. The thing is they just unlock the door and come right in. I don't think that's allowed. Right , I did get a chain lock for my door. But it still bothers me that he thinks he can get away with it. |

I think it is called break n enter. Your landlord has to give you WRITTEN notice 24 hours in advance. You paid to live in the apartment, and the landlord has not legal right to enter. Written notice is all that he needs to enter the unit and has a right to do so. If you want to be there while the landlord is in the apartment then you need to agree on a time for both of you to be there. Also, he has to have a legite reason to be there, such as repairs. You can replace the locks on the door. My last landlord did this. Entered through a door that entered into my bathroom. I put on a chain lock, pissed him off. I knew he was in my apartment because I could see his big footprints on my red tile floors. Tried coming in once when I was taking a bath, he did not know I was home. Started banging on the door after I put on the chain lock, that is when I gave him my notice. Try to sue me for breaking my lease, and lack of payement on rent but I sent his lawyer a letter stating all the reason for breaking the lease. They never responded back.
Now, as a landlord, I give my tenants the option to be home if repairs need to be done. Usually, they will make arrangements with relatives or they just have to trust me enough not to rifle through their belongings. My tenants almost always change the lock, wich I don't have a real problem with, but if they don't leave me a key when they move then I can charge them for a new lock. Read up on your landlord/tenants rights. It's is great knowledge to have.

bluebird, the LL still needs 24hrs notice no matter what state you're in.
The LL owns or is an agent for the owner and if this continues, file against him with a legal expert. |

That is completely illegal. He must post a 24 hour notice of entry on your door (or mail it to you) if he wishes to enter (unless you have already signed an agreement allowing this to happen). The only time anyone should enter your apartment without giving you 24 hour notice is in the event of fire, flood or major emergency. Check your state law, but here in Oregon, if you enter an apartment without proper notice, the tenant can get 1 free month of rent. I would not suggest changing the lock because management, by law must have a key. Good idea with the chain lock though! |

With our landlady, she gives us at least 24 hours if they are coming in to spray or change the filters in the ac or whatever. But if you have a matinance problem that you need fixed, they can come in whenever they want during office hours which for them is 8 to 4. I would agree that they should not just be showing up unless there is notice or you need something fixed. I hope this helps and you get your situation resolved. |

Only about 1/2 of US states have laws that prevent landlord from entering their units without notice or permission. You need the check your local landlord/tenant laws. |

I don't know about the laws where you live, but you might want to contact your landlord tennant act. To the best of my knowledge, they have to call you and give you 24 hours notice that they are bringing someone through. |
