My landlord still hasn't fixed the problems in my apartment and I am in a year lease, what do i do?
I have mold under my sink, the sink is so water logged it is going thru the floor, My window the whole frame is going to fall to the ground and no screens in any windows and I have small children. He has an obligation to you. If he is not fulfilling his obligation, than you can get out of your lease. You can take him to small claims court. Make sure you take pictures of the damage and take anyone with you that had witnessed his rude behavior.

Give him written notice that if the problem is not fixed immediately, you will need to stay at a motel until it is fixed as you cannot risk respiratory problems caused by mold - give him 3 days and make sure you get proof of delivery -
Then contact the health department, and see what advice they can give you-
If it is not habitable, he has materially breached the terms of the lease, and must give you your security back -
Get your kids out of their now!!!
MAKE SURE YOU TAKE LOTS OF PICTURES IN CASE HE FIGHTS YOU IN COURT!

This works in Florida. Check with your state to see if they do this too.

Go, and pay your rent at the county court clerk's office. The office will notify your landlord that you have paid your rent to them, and that you have a dispute with them. The clerk's office generally will hold your check until the problem has been resolved. You didn't break your lease because you paid your rent.

If you go to small claims court the judge will probably direct the landlord to fix the problems, and then you will get thirty days notice...........you are in a bad situation.........
When you say the sink is waterlogged, do you mean it won't drain? Were screens in the windows when you moved in? Did your kids damage them? Lots of questions you aren't real clear on................

Send a certified letter requesting repairs. (Always get a receipt)
Then send a second 10 days later. 10 days after that, send one last one stating that you are withholding payment until repairs are done. Then place the money in the bank in an escrow account. When he show up drunk, call the cops. When he tries to have you evicted, go to court with all your recepts. Make sure the money is in the bank!

If it gets that far, the judge will throw the book at him.

Oh, and find a new place to live! He will make you miserable after this.

Fax your complaints to the housing authority in your town. Then call them up and ask if they got your fax, which is in reference to the mold problem. YOu mention mold, they're quick to send over a housing inspector who will examine your place and fine your landlord.

He is not allowed to break into your apt. Only if there's water leakage, co2 gas leak, or fire can he walk into your apt. without notice. For all things he needs to give you 24hr written notice. If he touches your belongings it's theft and you can sue him and the property management co. that owns & manages the building.

If he retaliates, you write a letter and send it certified mail to his address outlining the problems in your apt. Make sure you write in there that you will now forward your rent payments to a trustworthy escrow service until he makes all necessary repairs. Witholding rent until he does is illegal and doesn't give you a foot to stand on in court. You can also notify the town sheriff if things get out of hand.

Call your local health department. Call the county local code enforcement office and make a complaint for substandard housing.
You have more rights then you know.

ive had this problem before... ill tell you exactly what to do... !!! You get it fixed yourself... since you've said you've told your landlord multiple times and he's done nothing.... call whoever you have to call to get it done and have them do it GET RECIEPTS FOR EVERYTHING... and subtract that from your rent... make copies of the reciepts and turn them in instead of your rent... it's legal ive done it... my parents are both court officials and they backed me up with this 100% .... (((say your rent is 500 and this work costs 300 hand in the reciepts and 200$)) e-mail me if you need more info
