My landlord thinks that she has the right to come over and inspect the house we rent at anyoint....?
our lease says nothing about why she can come over and we want to know if it is legal for her to come over at anytime and inspect the house without anyreason. she also makes no effort to call ahead just shows up. last night at 530om she came by and knocked on the door and said she was here to do a walk through. please if you know anything help us out because this is really annoying.

I guess i should add I am in Texas and as for my age Im 29. we dont have parties and the only pets we have are inside. I just want to know if she has to give notice or not because I have looked up the right to privacy rights online but it dones tell me enough. Our lease says" walk through inspections...An unannounced walk through to inspect the inside and outside of the house is a landlord's right in the state of texas. the tenant agrees that the landlord may do inspections of the property at their discretion." now the problem i have with that is that it doesnt say why she can come over and inspect. the things i have read online say that there are only certian things that she can come over for.

You did not state your age, but would be you are of student age, I have had people rent from me for a year, and never see the inside of their unit, and others have me over for the least little thing, like Pilot light out on a gas range, or Funny noise on fridge when defrosting, Even Changing light bulbs blown.

Your landlord has a right to do a walk through, in most states. I have that right also, but don't do it unless I see something amiss from the outside. I have found water heaters leaking while tenants are on break, and furnaces out at Christmas break also. When weather is Below freezing I check my units when tenants are out of town. It has saved thousands of dollars, and not one renter in 20 years has complained, because it is in the lease. I've had them actually shut off utilities when gone for winter break of a month, and that is Jan cold.

How many times has she inspected your place? Maybe she is suspecting a dog or pet on property. 5:30 pm is not a bad time,, after 7pm I think would be a bit awkward, Just tell her you are entertaining friends and you want privacy. Be prepared for a backlash though.

I have entered units that have had parties going, LOUD BEER DRINKING parties with a KEG, which is expressly prohibited in our leases. I Have had police call me to properties to shut down this type of party. I Have ordered the party closed and tenant to move the next day. Is that being an a**? Maybe, but it saved my house, even if it became empty till re-rented. One party had over 100 people there.

EDIT:: For those to say the landlord has to give notice, You had better check your lease, You don't know the answer. This property is theirs, and may check it any time they feel there is a legitimate reason. During Reasonable HOURS

A landlord must give 24 hours notice that they want in to do a walk through. That notice should be in writing, but doesn't have to be. The next time you pay your rent tell her that in the future you want the 24 hour notice that you are by law entitled to. If she shows up unannounced you do not have to let her in.

Generally a lease states that a landlord must give reasonable notice unless there is a problem. Showing up and knocking is not reasonable notice. She must have has serious problems with prior renters to be doing this.

Try reading your lease very carefully. A standard lease has protections for both landlord and tenants. Then try talking to her about this, calmly, and ask why. Tell her you are good tenants and understand her concern, but would appreciate some notice. After that, when she shows up, tell her it's not a convenient time, you're at dinner, have guests, some one is napping, whatever.

The specifics probably vary from state to state, but your landlord is legally required to notify you in advance, usually in writing, before they can inspect your house/apartment.

As for the landlord that said you had better check your lease: you can not sign away rights guaranteed to you by law. If the law in your area says notice must be given, then it must be, whatever the lease says.

Kick her *** out....tell her to make an appointment with at least 48 hr. notice, then tell her to talk to your lawyer.
Don't have a lawyer...try calling 211, and hope you live in an area of the United states. You can also google tenants rights/your state for more info. Actually once you pay the rent the property is yours, for your habatate, and the owner took the money to seal the deal. Most of these are on 30 day periods.

I am almost positive, that the landlord cannot just come to your residence anythime she feels like. Also, the are suppose to let you know ehrn they want to inspect the place.

Its legal mate unfortunately but its also legal to tell her what time and when to come round i am also private renting i have not seen my landlord for a year he wont come round lol but if shes becoming an issue the best thing to do is find a set of large bolox and tell her straight. I think you should sit down with her - over a nice, hot cup of coffee/tea and like two or three or however many adults are on the lease, discuss ALL the "gray areas" of your lease.

This includes

the grace period,

written notice moving or rent increases,

repairs, reasonable notice for property inspections

property maintenance - including cutting the grass and shoveling snow, etc.

and all the other "gray areas" which concern you - including oral arrangements which were discussed, but which were never put in your lease.

Before your meeting, you should also prepare a list of all the things wrong with the property or repairs the property needs. Your landlord doesn't have to do those repairs, but it should be made to protect your security deposit.

They have the right to inspect their property at any time without reason, however, they are required to give you 24 hours notice whether written or verbal.

I have friends that never did an inspection of their property, the renters stopped paying rent so they filed eviction to get them out. When they finally got them out then went into the house and not only did they stop paying rent but they had stopped paying utilities. There was human crap filling the toilets, the bathtub it was all over the floor, the walls, bojangles boxes filled with chicken and maggots all over the house, in the closets under the beds, buckets filled with pee. If they had done inspections regularly they could have prevented this from happening by getting them out earlier.

the tenant landlord law should state that the landlord must give you advanced notice of inspections and repairs unless it's an emergency.

Google the tenant landlord law for your state if you can locate the law then advise your landlord in writing that she is required to provide notice to you before showing up and inform her that she cannot just show up at will. She might squawk but as a tenant you have rights too, you should never be at the mercy of your landlord.
