I am currently more than half way through a 2 year lease (I have until April) on a $995/month apartment. I have been complaining to the Health Department about a lack of sufficient heat. Now, my landlord would like to pay me to break my lease and move out by Dec. 1st. How much should I ask him to give me? I feel like I really have the upper hand because he wants to "get rid of me and my complaints." Additional Details Thanks for the "too cute" answer. I have lived here for a previous winter, and know the heat requirements. I know it is only October and we are already living in a 60 degree apartment, I don't want another winter of shower less mornings and sleepless nights. Thanks for the help(?) though. |

How much will cost you to move? U-Haul rental, someone to help you, gas to the new place. Any application or credit check fees to get the new place? Cost to transfer utilities services to the new place or turn-on fees? These, plus a full refund of your existing security deposit, plus one month rent if he gives you at least 60 days, or 2 months rent if he gives you less than 60 days = your target.
But don't give him a specific amount! ASK him what he is offering you to terminate the lease early. If it something near your target (or better than!), take it. If you specify a number, you cap the negotiations and the only way those numbers are going is down. Get him to make you offer and that number is the floor, and the only way they can go from there is up. What if he wants you out so bad he'll pay you $5K?
On the other hand, now that you have done your homework, you know your bottom line and have a rational basis for arguing the numbers up if he tries to get away with a measly grand. |

Whatever you do, get it in writing. Something like "This terminates the lease and releases me (the renter) from any further monetary obligation" - basically saying the landlord won't come after you later for more money. I'd probably ask for 2x a security deposit on a new place, or 2 months rent. Don't get greedy, the landlord might just laugh at you. Keep it reasonable. |

Legally he has to pay for you moving fees and relocation fees. That means if you need to stay at a hotel while waiting for another apartment that YOU choose, he has to pay. It's actually not that bad of a problem, happened to me and I found a better place with lower rent. Hope it works out for you. |

Dont ever think that you have the upper hand. The rental business is very incestuous and you are going to want another apartment, Dont forget references, if you get a local reputation for being a pain in the butt, you might find that the next apartment you want "has just been rented". I am sure that it cant be that cold yet and I bet he is giving you the legal requirement. Do not make the mistake of being to cute for your own good. You may win this battle but land up loosing the war. Think about it.
Nice to hear that you squeezed $1990 out of him, but did you stop to think for one moment why he gave it to you? Folks do not give money away for nothing. I wonder who has won the war in this case. The only place i know to get a free meal, is in a mousetrap. |

It should be the same as you would have to pay to break your lease. Most places that is equal to your security deposit. It should state in your lease what your lease break fee is.
