Confused! | My landlord wants us to be away from the flat for 4 hours? |
My landlord has given us 24 hours notice, by text message, that he wants us away from the house for 4 hours as he has a mortgage assesser round. We have just renewed our contract and its a new home, hence he probably has a 2 yr fixed mortgage that needs renewing. Can he do this or do we have a right to actually be in the home whilst this is being done? At the moment I am questioning - does it take 4 hours for a mortgage assessment and why would it matter if we were in the house if the original mortgage was a buy to let. I get the feeling that he is going to pretend that he lives there! |

No, he can't require you to be away from the house.
Legally, he must give you notice that these people are coming round as he has done, and you must allow them to enter. But that's all. He cannot legally dictate whether you're in the house or not at the time.
Of course it doesn't take four hours for an assessment to be done - unless the person coming has given him a wide timeframe of when they might get there, instead of giving him an exact time.
I think you are probably correct in your assumptions that he is going to pretend he lives there, or there may be some other reason, but either way it all sounds a bit odd.
However, you need to bear in mind that if he doesn't get such a great deal on his mortgage this time, then he's just going to put your rent up to cover it. You say you've just renewed your contract, but you only need to be six months into your contract for the rent to be increased - he doesn't need to wait until it expires. |

agree to his request and park where you can see whats going on if someone turns up ask them whats their business as its your house or walk in on them when they are inside - say you forgot your mobile phone ask then . might also be a good idea to have your lease contract looked at by a professinal just to see where you stand |

Got it in one. The chances are this landlord is pulling a fast one and trying to avoid having to have a landlords letting licence.
Not sure if he can request you leave the house for four hours, but would think this is not legal. |

hiya, some think is not right.he is up to some think but WHAT?IF you live in the uk,then go to citizens advice who will be there at your flat for the 4 hrs your land lord wants you out.he will find out what is happening.if you don't want him there,then he will tell you all of your rights as a tenant.its a free service and c/a are there to help you. |

I can't imagine he has any right to make you vacate the premises for that reason. Certainly not in the US. You have every right to be in your home, especially if a stranger is entering. I'm not even sure you need to let the assessor in. Such a visit inside your private residence should at the least be scheduled at your convenience, not his. |

Your last line got it in one! The only conceivable reason that i can see for this would be if he has not informed his mortgage provider that the property is being rented out and does not want that known. You could say that it is none of your business and as you have just renewed your rental contract in is in your own interests not to rock the boat! |

It does sound a bit strange. As you say if the mortgage was buy to let, what is the problem with you being there? Having said that, if you like the house and it is going to be awkward for you to move, you will need to keep the landlord sweet, perhaps you might want to do as he says and not 'rock the boat'. I would certainly wonder if I could trust the guy. |

I would seek legal advice as tenants you have certain rights and the landlord must give you reasonable notice to terminate your tenancy which is more than 24hrs.
