My landlord wont renew my tenancy agreement what should i do?

if your tenancy has expired then im afraid that there is not a lot that you can do.Your landlord is within his rights not to let you extend your tenancy.Sorry but it looks like you have to find another house. You could always squat and claim them writes but would you really be able to live ithout gas and electric and be affraid to go out of the house incase he boreded it up while you was out.Move on and look at it as a fresh start. As far as I know, he needs to renew the tenancy agreement every time it expires if he wants you to stay in the house. Any professional landlord would do this. It covers him as well as you!

Without an up to date tenancy agreement, you could leave at any time without giving notice. Bad for him. Alternatively, he could just run off with your deposit and never come back. Bad for you.

I would tell him that you want a new tenancy agreement, or you are going to move out. If you really want to stay where you are, be very careful - and go to a solicitor. I really wouldn't stay with a landlord who wouldn't give me a tenancy agreement.

One last point - I'm on a 6 month tenancy. When that ended, we asked to stay for another 3 months. I am renting through a letting agency (not a private landlord). We had to put it in writing that we wanted to stay for another 3 months and sign it at the bottom. Although we haven't received new tenancy agreements, we know that we are still covered by our old one. Check through your existing contract to see about 'rolling tenancies'.

I am a landlord, there is nothing unusual about your situation, in fact it is because your lanlord feels you are the sort of tenant they want there is no need to issue a new agreement.
If you read your agrrement it tells you that after the initial agreed period you can just carry on with the same safeguards you already have, you, or the lanlord still have to give notice but if you are a "Good tenant" then you will be greatly appreciated.
I have 4 long term tenants on a running lease like yours will be, so forget all the scaremongering and just talk to your landlord.

It sounds like he's not kicking you out. It sounds like he just wants you to be month to month which requires doing nothing once a lease has expired. Maybe he has plans to sell the place and; therefore, doesn't want his tenants locked in a lease.
You just need to ask him.

there is nothing you can do all you can do is buy time by refusing to move he will then have to take you to court to get and eviction order then summons bailiffs to enter your property and change the locks it can take about 12 months and at a cost to him of about £3k

I presume that if you have renewed your tenancy twice before, then you are on a Shorthold Tenancy Agreement. With STA once the initial term has finished, 12 months in your case, and the tenancy is not renewed, but the tenant stays in the property the tenancy will continue as a Periodic Tenancy until the landlord or tenant decides to end it.

The landlord must end it by serving at least 2 months notice.
At the end of the 2 months the tenant can leave if he or she wishes or wait until the landlord has obtained a possession order from the court. Once the landlord has served the CORRECT notice, you the tenant can leave at any time, you do not have to wait until the two months are up, and you only have to give the landlord minimal notice and this is not enforceable.
If the landlord wants to evict you, he has to serve the correct notice section 21 (a) with the correct dates on it, this is very important, if the dates are not correct, when he goes to count they will throw it out and he will start again !

So here’s how it goes:-
Landlord serves you with a section 21(a), with right dates.
After 2 months landlord applies to court.
Courts give landlord a date for hearing, you can go and state your case if you want, very informal.
If the judge finds on behalf of the landlord, he will give you 2 weeks, usually to go.
If you don’t go landlord goes back to court that issue bailiffs warrant, usually takes 1/3 weeks.
You, as the tenant can leave at anytime in the proceedings, right up till the day of the bailiffs, without flouting the law.
IF the landlord wants you out this is the procedure he needs to follow.
IF you had signed a new agreement both him and you would be tied in, have you thought that maybe this is why he does not want to tie him self in to 12 mths ?
All landlords should know just how long it take to "remove" a unwanted tenant, not to mention the cost.
Good luck, you have the upper hand, don’t let him bully you.

you have 2 months to leave after he gives you notice in writing. By law, he has to give this. (even if the tenancy is ended.

Go and see your local council - They can deal with your landlord on your behalf. If you are made homeless by no fault of your own, you can get help with homes etc.

most landlords get you to sign a 6 month tenancy
after the 6 months have exspired you just carry on renting.you do not have to renew another tenancy.the object of a 6 month tenancy is that you will be there for at least the 6 months.i know this as i lived in a flat for 12 years and only signed the once for 6 months it is like saying that if you live in a council house you got to renew your tenancy every year i dont think so how many council tenants do you know that renew every 6 months not any i bet

Whether he has renewed it once twice or never before is entirely irrelevant, and I have no idea why he should think it is. The whole reason for having a tenancy agreement is so that when it expires one or other party can decide not to renew it. Put it this way, if the agreement was coming to an end and you wanted to move out, how would you feel if the ladnlord told you you couldn't simply because HE wanted the tenancy agreement renewed.... and you can't have it one way and not the other.... he is under no obligation to renew the agreement, does not have to give you any reason why he has, so the best thing is to look for a new place. Staying on and struggling against it will merely ensure that your new landlord will get a terrible reference for you off him...... so you don;t win that way either.....
Ah - I see - fact he wants you to stay changes everything - would have been handy to know that at the start - answer still remains 'move' as you should never occupy a property without a contract....

move out..he wants you to stay and will not renew it...this is putting you in a vulnerable position...if you stay without it he can put up the rent, give you no notice or even sell up without telling you...you will have no rights..be careful...if he is not up to anything he would insist on renewing your agreement for his safety and yours...you have more to loose than he does....
