My lease ends but my apartment won't let me leave?
My lease is ending in a few days. However my apartment complex says I need to give 60 days notice before I leave, and will bill me for these 60 days past when my lease is up.

Shouldn't my lease expiring be enough notice that I'm leaving? Or did I miss something? What should I do?

I'm sure your lease state you need to give 60 days notice to vacate...at any time during or after your lease expires.

Read your lease. It probably states that after the initial term it goes month to month until cancelled with a 60 day notice.

This is most likely in your lease. Most apartment complex's have a 30 or 60 day notice period so they can begin to find a replacement for your apartment. Unfortunately they are right. I'm not sure if the 60 day notice period should start on the day you tell them or from the day your lease is up. Check the lease (they should be able to provide a copy that you signed when you moved in).

If you don't have a place to go yet you can ask to go on a month to month lease with them until you find something. Just be sure to at least give a 30 day notice (I don't think they can require a month to month tenant to give 60 days notice but check whatever they make you sign to be sure). This may help reduce the amount you pay for when you aren't living there.

From here on out always get and keep a copy of your lease. most complexes will remind you about 90 days before your lease is up that you have to give a notice. Just think of this as a live and learn experience.

My lease is the same way - you needed to give them your notice two month ago. It's probably in your lease details. Can you rent there on a month to month basis for two months?

Your landlord/management company should have sent you a letter notifying you that your lease was expiring in 60 days.

Reread through your lease agreement that you signed. If it specifically states the 60 day stipulation, then you are responsible to pay them. If not, then you owe them nothing. They could try to sue you for the money, but without a written agreement or posted policy, you would have no way of knowing that a 60 day notice is required and it would not hold up in court. I recently read through my apartment lease agreement and it specifically says that, if I decide to leave, I must give 30 days written notice prior to my lease renewal date.

The answer is in your lease you signed. Some states require the landlord (or management company) notify you that the lease is ending prior to the 60 day notice time so that you CAN notify them within the 60 day period whether you are renewing or leaving. Chances are, they are correct here and you must give 60 days notice.

You usually have to give them 30 to 60 days notices that you will be leaving even if the lease term is up. Most apartments will send you a notice within a few months of the lease expiring to find out if you are renewing or if you plan on leaving. If you're leaving, you have to give at least 60 days notice.

more than likely there are some rules/regulations that you were unaware of. maybe you should look back at the fine print in the lease that you signed. either that or they are just being jerks! asked to see the papers first to see if they can make you hold to it!

i'd read your lease over. if it's stated in there that you need to give 60 days notice then you are liable. if not then your not.

This is another way landlords can screw their tenants out of their security deposit. When I was renting 30-days was the standard notice and, if it wasn't given, the management company would apply the balance left on it toward that outstanding month
Most people are unaware that notice must be given even though the lease has expired because most people don't read their lease. You can't stay on and give notice because you've already committed to a new place and you've probably switched your utilities over so you wind up taking a loss on the deposit and the managment company winds up with free money.
Landlords are scum. i'm so glad I own my home.

You ALWAYS have to give notice. Just because your lease is expiring doesn't mean you are going to move and landlords are not mind readers. Put the shoe on the other foot, say you weren't going to leave and the your lease was expiring so the landlord just rented out your apt and says you have to move when you didn't want to move. Same thing, we are not mind readers and everything has to be put in writing.
