Month to month is the same as youre previous lease but you are not locked into it, So you can move at any time with a 30 day notice without having to pay off the complete 1 year lease.
In my opinion it's better just incase you find something better. |

A month to month is a bad idea. She would still have to give you 30 days if she decided she didn't want you there any longer, but she is free to increase the rent every 30 days if she wants to. With a lease you are locked in at whatever the term is when you sign. |

Read your original lease it probably says that at the end of the first lease it becomes month to month.
How much notice you need to give will depend on what is written into the original lease and on the rental laws of your state. The lease will remain exactly the same as it was since you moved in except that it is now month to month rather than a 6 month or 1 year period. This means that the landlord can change anything she wants about the lease by giving you only 30 days written notice. It also means that either of you can decide that you will move out by giving 30-60 days written notice. Not a good choice in rentals for the tenant or the landlord. |

You could AND you should write her a letter about your conversation about the month-to-month lease.
It should read something similar to this:
March 1, 2008
Dear [Landlord's Name]:
I just wanted to write a note clearing-up the discussion we had on ______ [Date] about the property I'm renting from you.
We talked about the lease being a month-to-month lease and the rent was going to stay the same at $_____.
Thank you very much.

Lease is much better. Its assurance that you will not have to move until the specified date. Even if she tries to sell it the sellers cannot kick you out until the lease is up. |

when a lease expires..it is the option of the owner/lessor in almost all cases to renew or not...upon expiration.. the tenant / land lord contract reverts to a *month to month"..that being stated..if you were asked to move..you have 30 days upon the request...like wise..you are required to give a 30 day notice if you chose to vacate...either way..if i were you i would read the writing on the wall...they chose NOT the renew the lease...ergo..they have other plans for the dwelling....start looking....good luck |

It is not unusual for a lease to become month to month after the original lease term has expired. The terms will be the same as the original lease and there should be a clause in it stating that it will become month to month. You need to give 30 days notice in writing before moving out, and the landlord needs to give 30 days notice before going up in rent or changing the orginal terms. I personally think month to month is good for the tenant. |

Most leases automatically roll into a month to month tenancy after term. Unless you leave or renew the lease. The original contract probably states these details. Month to month gives you a continued tenancy in the property, but only for 30 days at a time. The landlord can show you the door, with proper notice as determined by state law. Or raise your rent, again with proper notice and subject to state laws. Good for you to have the option to move out when you want, bad for you to be subject to rent increase and possible rental termination on short notice. Read your contract for specifics. Good luck. |
