My lease is up; do I have to move??
Our lease was up the sixth of April. We received no notice to vacate, but our landlord did call us and mention that his son was wanting to move in in May. We are looking to buy and don't have enough time to do that before May. We have received no written notice, and we have lived there for almost two years. You'll have to read your lease. Some leases have automatic renewal clauses; others don't. If your lease does not say that it is auto-renewing, and your landlord hasn't renewed it, then your lease has expired and you are now renting without a lease; i.e., month-to-month. Your landlord still has to give you a written 30-day notice to vacate in any case.

Normally I wouldn't bother answering with this many people already trying, but no one got it right.

Generally once your lease term is completed you revert to a month to month renter and all the terms of the original lease remain in effect. This includes the requirement to give written notice (length of notice varies from state to state) of your intent to leave the property or vice versa. Usually this clause in the lease is there because it is a State Law. And, it isn't uncommon for a landlord to simply forget the law when it comes to asking someone to leave. There for, I suggest you reread your lease, all of this info will likely be there. Then call your landlord and tell her the truth about your situation and the lack of a written notice. I hope you paid for a full month the last time you paid rent ... you might need this landlord's help when getting financed to buy a house.

A conversation needs to take place between you and your landlord.

If there is an auto renewal clause (not common) then you are in good shape. If not then you are on a month to month and he can have you out with 30 day notice.

Also if you are looking to buy a house with in the year and you know your going to, then you do not want to be locked into a years lease. Try negotiating a 6 month lease and reevaluate it at that time.

First read the lease, if silent, then next look to see if your landlord gave notice to end the lease on the fixed date set out of the lease, if not then by your state statute the lease went to month to month with the same provision outlined in the fixed term lease

Therefore under those facts if you are month to month either party with a month notice may end the lease, at this time it does not seem the landlord gave a month notice to end, so no the son can not move in may because the landlord has to give a month notice, can the landlord give notice to be out by end of may yes if done right

Most lease agreements require at least a 60 if not 90 day notice by the renter to the landlord on their intentions for living arrangements after the lease. That way the landlord has time to find a new tenant. If you don't give them notice, then they have the right to assume you will not be staying and can (and will) evict you at the end of the lease if they choose.

Your leas is up, Month to month is by mutual agreement, not by you just holding over. He has given you notice and you are actually tresspassing. Be hard to get cops to move you, but you have been put on notice. In Illinois the LL has to give 60 day notice that he will not renew your lease. but once the lease is up and he gave you 30 days, that is all that is required.

Saying you don't have time to look for another place is a cop out, get in gear and find somewhere else to move. I have viewed a house on Monday and closed on Friday,, I know that is really fast, but it happens. Just look for someone that is in a hurry to move.. Look in the newspaper for sale by owner, they will be the fastest way to find a desperate seller. I think... Sometimes you can get possession before closing by working with the actually owner. But get preapproved for a loan first.
