She can file an eviction after you are gone, this will enable her to collect her rent as well as to warn your future landlords that you will screw them.
Evictions are recorded on your credit report. |

Hope your not trying to use your security deposit as rent...that is illegal in all states.
Worse case scenario: She will sue you, get a judgment...garnish your wages, attach your bank accounts, levy your IRS returns and place liens on any property you own now or in the future. Having an eviction on your record will make it nearly impossible to rent elsewhere. |

Next time you need to rent a house or apartment you will have a bad reference, and bad credit, it will make it hard to rent again. Also be sure to clean really good so you will get your cleaning deposit back.
Some places are real fussy, they even check the exhause fan for the stove and dust on the ceiling fan. If you scrub the bath tub and don't rinse the soap out all the way, they say it is not clean. |

What makes you think you don't have to pay for October when your lease isn't up until NOVEMBER 1st?
Yes, you have to pay it...she won't evict you if you leave, but she can sue you and ruin your credit if you don't pay it.
Be sure to take pictures of the place when you leave and make sure she is present for the walk through and you get a copy of any damages she is claiming that you have to pay for. |

Tell your landlord you would like to see the bank book proving he or she has placed your security deposit in an interest growing account. Which is an account seperate from their own personal account. If the landlord can not produce such a bank book. Because by law, your security deposit is not their money. It is your money. It should be treated as if you had it yourself in the bank. And it has been growing interest for the amount of years you have been living in your apartment. If this hasn't taken place. And your money was used for your landlords own personal use. Or put in their own personal account. Contact a lawyer hon, you have a law suit. |

The sheriff is the only one who can do an eviction.
Only after there has been a default notice in court, signed by the judge.
She can go after you for rent not paid, even after you move.
Depending on where you live, it could take 6 months to a year. ( If youre moving to another state, youre home free)
The only one who can legally remove things from your apartment, is a sheriff , with signed warrant.
If your landlord tries to change your locks etc..they are in violation of the Code of Federal Regulations. Then, you can sue for damages. |

There MAY be an out. If, when you moved into the property, you paid first and last month's rent plus a security deposit; you may be able to argue that. But I wouldn't upset your landlord.
Just pay the rent and start moving your stuff out early (things you can store and don't need). Be absolutely sure that you get an appointment for a final walk through of the apartment on the final day when the apartment is empty. This way you can hand her the keys to the apartment and NOT putting the keys in a "Drop Box".
I've known plenty of landlords abusing this. "There wasn't any keys in there." Then you'll see your deposit disappearing.
If she does not show up for final walk through, take plenty of pictures of the place with a non digital camera (disposable is fine) to "prove" the property's condition. Mail the keys certified with a return receipt, that day. Also call her to let her know she'll be getting the keys in the mail.
