My mortgage company said my HOA cant foreclose on me for past due fees is that true?
my mtg company said my HOA can not foreclose on me for any reason because they do not own the property..that only my mortgage company can foreclose on the property or the county can for past due taxes(which we do not have)...is this true? we are in tampa florida..If this is the case, can I go after the HOA & their attorney's for filing false papers and trying to charge me for services they can not even render...I have been told that many HOA's & attorneys do this as scare tactics to get their money and most people wont even question that practice....any help would be wonderful.....I dont want to lose my home and have to uproot my 2 young children

Yes, they can foreclose, you signed the right over to them. That is how they enforce rules and payment if you try to screw them over either.

Make sure you are talking to someone who knows what they are talking about at the mortgage company, not the receptionist.

The HOA would not be able to enact foreclosure proceedings. However, they would be able to file a lien against your property that would have to be paid before you sellf or refinance the property.

The HOA is likely owed money and are trying to collect on a debt. Your best bet is to pay them now before it becomes a nasty suprise in the future.

I know in California there are rumors of the HOA foreclosing on people.
I would ask my accountant to check the laws for me. If you use an accountant you pay them for the entire year of tax advice not just to prepare your taxes. I would really like to hear what a estate person who know the laws in your state has to say about this.

If you do not have a mortgage, the HOA may be able to foreclose for unpaid dues. Most likely, they will take you to small claims court, unless you have a huge outstanding balance. Regardless, they will put a lien on your home. Then when you sell it, the buyer's loan company will pay the lien before you see any money.

Simply put, Yes they can foreclose for unpaid HOA dues. In lieu of "going after the HOA for filing false papers, take the $ you were going to use to go after them and 1) pay the unpaid amount 2) If needed and as stated previously, hire a R.E. Attorney.

They can't foreclose on your property, but they can put a lien on it. You won't be able to sell it until you take care of the lien (i.e., pay your dues).

They can only foreclose on you if they have a Mortgage, Otherwise it is something else. liens are not Mortgages, but a judgment can force sale of your unit. My friend long time ago had a dog in her unit, and the condo association threatened to sell the unit if not removed within an hour. Pure scare tactics.

I'd check with a real estate attorney. Where I live they can't simply foreclose, but they can file a lien and foreclose the lien. I'd pay some money and check it out. Also, pay your bill.

EVERYONE THAT HAS POSTED THAT AN HOA CANNOT FORECLOSE ON A PROPERTY IS DEAD WRONG.!!!!

Yes they can, and I have no idea of what $8.00 an hour employee told you that because it is WRONG.

HERE IS THE PROCEDURE THEY FOLLOW:

First...they place a lien against your home...an attorney that works for the management company places a lien on the title for fees past due.

Second, after so long, the HOA (according to your bylaws that you SIGNED at closing), they start foreclosure procedures to force the sale...your mortgage gets paid first (because it's in 1st lien position) and then the HOA.

ANYONE who places a lien against your home and has the legal right to do so, if you DEFAULT, can force foreclosure procedings.

READ THIS CAREFULLY: All lienholders !!!

What is a mortgage company? A LIENHOLDER!

HOA's can actually do it faster than mortgage companies b/c there are laws that have been passed over the years to make this process easier.

Your mortgage company DOES NOT OWN your home...YOU DO...a mortgage company ONLY has a lien against the property.

It is not a scare tactic....if too many people in HOA stop paying their bills, how do you think that services get paid? By the HOA fairy?

Services GET CUT OFF FOR ALL RESIDENTS if the fund goes into the negative b/c of deadbeat homeowners that won't pay their bills. That places a negative impact in the property values for everyone.

PS: Do a Google search of HOA and Foreclosure...you'll see tons of cases where it does happen..b/c it's a BUSINESS.

Mary B is 100% correct

However, the HOA would be better off garnishing your wages...which they can do if they know what they are doing. I have done this tactic with several people who have owed me money in the past. Its a lot easier than you would think to do to.
