Is the landlord aware that you have been living in the place as well? If you have belongings in the apartment such as clothes, personal hygiene, etc. and you receive mail there then you do have some rights - commonly known as squatters rights. I would try and see if you can stay if the landlord is aware that you are there. But if they were not they would have to file an eviction to get you out. Costly for them...so they would probably be willing to work with you.

The landlord will want to keep the place occupied. If you can afford the rent on your own I'd simply get in touch with him/her, explain the situation, and ask to get the lease in your name.

Maybe not, but it varies by state. If you are same-sex partners in a close-minded state, then civil marriage laws won't apply.

However, if you're not same-sex, then you might be legally married because of the long time you spend together. If so, then you may have rights.

Get a lawyer if it's an issue.

It could be simple... You might ask the landlord about it and he/she may not care. If you want to stay and they want you to leave, however, then make sure you want to be where you are not wanted. If so, then get a lawyer.

If the lease is ONLY in his name, no, you have no rights. Please contact your landlord immediately and see about putting the place in your name if you plan on staying there.

u should totally get a lawyer hun... itll depend on what state u live in first. wow, what a pickle.... how's ur relationship with him family? cuz theyd have rights foremost if u werent married.......

Could be a little tricky. On my lease (in CA), if someone else is staying with me for more than a couple of weeks, they need to be added to the lease. I suppose your landlord could be terrible, but in general I would imagine he would be happy to switch it over to your name. The old lease has been terminated, and you are an immediate renter. Finding someone else will cost him time and money.

Is tenancy as in rental as as in the ownership sense?

Unless you are of opposite sex and live in a community propery stae you have no rights.
