Boleyn | My pediphile landlord is charging me $60 rent per cat ea. mo., plus 800$ deposit for companion animals? |
I gave him a letter that they weren't pets but actually companion animals [I have MS & am Bipolar]. We had a hurricane and were homeless, there was nowhere else to move to. He said "If you don't like it, I don't have to rent to you" which IS TRUE. Should I go after him to pay back all this money AFTER I move, or do it now? Is it legal what he's doing if I signed a lease saying I would pay this money? Additional Details He's a registered sex offender from 20 yrs ago, honest. |

Do you have receipts saying how much you paid? If not you have no proof. If you paid a pet deposit than he can't just add on extra money each month, and he can't kick you out for refusing to pay more money than you agreed to pay in your lease. |

What on earth do you think pets are for? Every pet is a "companion animal". He does not have to give you any money back. You want pets on his property you pay the pet fee.
It is completely legal to charge any pet fee he desires. Your letter means nothing. Letters do not make your pets Certified Service Animals, which is the only thing that would exclude them from a pet fee.
I do not even think any Service Animal providers train cats, mostly dogs, although I have heard of a few miniature horses that got their certification.
Pay the fee or get rid of the cats. |

If your lease says that there are fees for animals then you must pay no matter what the reason. He doesn't have to pay back anything as everything he is doing is legal.
You should be careful calling people names like that as you can be sharged with slander. Then you'll have lawyer bills too. |

Unless you live in a place with laws that limit rent or rent increases, the landlord can set any rent he wants and you can choose not to live there. You get the deposit back when you leave unless there's damage.
What does that have to do with him being a "pediphile"? (That's someone who likes walking?) |

"Companion animals" are nothing more than pets, and do not qualify as "service animals", which are animals specially trained to perform specific tasks for their owners. As we both know, cats can't be trained to do anything other than to purr nicely for their owners.
If you didn't like the terms of the lease offered, you should not have signed the lease. Your only 'out' for this lease is to be able to prove that you were not mentally competent to sign it when you did. While that sounds inviting, it's extremely difficult to prove
Your other alternative is to rid yourself of the offending cats. |

If you are so sure that you have a case, hire an attorney. But the fact is that you signed the lease and agreed to the terms put forth. You cannot retroactively take it back and complain now that it's not fair. |

Who cares if he is a registered sex offender if he doesn't re-offend? You went to him to rent, he didn't drag you in by gun-point.
And don't give that about "Companion Animals." If it is not a registered Service Animal you don't have any rights to it.
If you don't want to pay extra don't rent from him. "Get back" what money? You don't "go after" it. After you move he will assess whatever damages and clean-up there is and charge you and return whatever might be left. Read your lease. |

There's no difference between "pet" and "companion animal". There's no way that your cat is a working animal akin to a seeing eye dog or something like that, so you can really stop trying to play that angle. No one will buy into it.
The bottom line is that landlords have every right to forbid pets and/or to require hefty security deposits for pets. If you don't like it you can live somewhere else.
Finally, your landlord's pet policy does not make him a pedophile. |

Anytime after you sign a contract (lease), you are agreeing to all of HIS terms and it's hard to fight against any contract you have signed. My best advice, would be to call a lawyer and just ask. There have been plenty of situations where I was unsure it I could take legal action and I called an attorney and explained the situation. They will usually tell you right away over the phone if you have a case or not (for free). Also, you can get free advice and information, by contacting your local Legal Aid. |

I have recently been apartment hunting and have realized that places usually require you pay a deposit if you have pets and some also charge an additional fee per month. I know that if no damage was done by your pets that you should get your deposit back in full. However, I am unsure about the 60 per cat each month especially if it was written into your lease. your best bet is to go to a community lawyer and have them look over the lease agreement and ask for their professional opinion. a lot of colleges provide free services. |

He can charge you whatever he deems necessary. You have the option of renting from him or not. |

As the others have stated, there are two types of pets.
Service animals and companion animals.
Service animals are trained and certified to perform a service (think of the guide dogs that some blind people use).
Companion animals are the pets that everyone has. Thin about it. they do not perform a service except to be a companion for their owner.
No landlord or agency is required to allow a companion animal on/in their property. Landlords can charge extra rent, extra deposits and hold the tenant liable for any damages done by a pet (companion animal).
Landlords are not allowed to charge extra rent for service animals but can hold the tenant liable for any damages caused by the service animal.
Just remember that to be qualified as a service animal they need to go through special training and get certified.
As for when you should move, that's up to you. Most landlord's will charge more for pets.
Good Luck!

What? He's a pedophile and you're more concerned about your animals?? Report him to the cops if he's really a pedophile... or are you just saying that because you don't like the fees? |
