Unfortunately, it's your word against hers without a written agreement. You're out $3k.

Just know that even if she agreed to it....it's illegal.

An agent can REDUCE their commission, but they cannot give you cash at closing or outside of closing.

It's a felony.

That is against RESPA (federal regulations) as well as the bank won't allow you to make money on the deal.

I would file a complaint for unethical behavior...make a complaint with both the Realtor Association and the Board of Realtors (they are very different).

Even if you lose, you don't know if someone else has filed a similar complaint...that is why it's important to file it anyway.

PS: She KNEW she couldn't pay you to start with...that is a very, very specific issue that is taught in all Real Estate Schools when we get licensed.

Also remember that real estate contracts are different from any other type of contract law...it MUST be in writing to be enforceable.

Sadly there is nothing you can do since it was not a written agreement. My best advice is for you to sumbit a complaint with the Real Estate Board that governs your state. You might not get the money but at least the agent will be flagged with a complaint. Good luck!

Expert Realtor's answer is correct. It is a violation of RESPA. Actions such as that are one of the reasons the housing bubble was created.

You're not going to get the money. Sadly, you accepted a verbal commitment which holds precious little legal weight. The best you can do is to file a complaint, but attempting legal action is a waste of time on your part. You won't prevail.

If it is not in writing then there is nothing you can do. Write it off as a learning experience and hence forth get every thing in writ ting.

Giving a REALTORS commission as a cash inducement to a buyer is not legal.
Giving part of the REALTORS commission toward the downpayment or closing cost to a buyer is allowed in most states. However, the buyers lender needs to be informed about the $ amount, approved by the lender, with the $ amount shown on the HUD 1 closing document.
Having said all that, it's a shame you did not insist, on the agent noting this verbal promise, in writing on your buyer agency agreement.
I don't think a complained to the local board or RE Commission will accomplish anything, but if you have the time and inclination, I say go for it.
