-THIS IS NOT IN MY LEASE
-I DIDNT SIGN ANYTHING STATING I WOULD PAY THOSE CHARGES
- I ALREADY PAYED THE FEE'S FOR MY CHECK BOUNCING AND OVERDRAFTING HIS ACCOUNT.
-I STAY IN A CONDO NOT REGULAR APARMENT.
-I INFORMED HIM IMMEDIATELY WHEN I FOUND OUT THE CHECK BOUNCED.
WHAT DO I DO?? Additional Details He is charging me for all fees incrued because of my check. So the fees are for his use of debit card/checks after my check bounced. |

I would ask for receipts of fees he is charging you because I bet he is including other fees that are not associated with returned check fees.
If he cannot prove these fees he is talking about then check your lease agreemnet and see what it says about returned checks because it should be in your lease if not then go see a real estate lawyer and get a free consultation.
Your only responsible for returned check fees bot anything else.

Your check is a contract for timely payment, so you are liable for the damages caused to him for your failure to pay on time.
He needs to provide proof to you of the bank charges. Banks are notorious for running-up overdraft fees as much as possible (overdrafting large checks first), so $470 is easily conceiveable.
Your landlord can take you to small claims for damages. However, the amount owed is probably an issue seperate from your landlord-tenant relationship. Check your state's laws and rental agreement, but your landlord may be required to apply your payments to your rent first. Also, if your lease specifies a return check fee, then you may be able to argue to that your liability is limited to that amount. |

I agree with SCOTT. If your employers check bounced and you wrote several checks that you had to pay fees for, wouldn't you want the employer to cover them all? |

If it was $100 I'd say pay it - just because your check is never supposed to bounce and that sucks for your landlord. BUT the fact that it is $470 is ridiculous! You do not have to pay that ... from what every single bank goes by - you are never supposed to spend money on a check that hasn't cleared yet. After you deposit a check - you need to wait several days to make sure it is cleared before you can spend on that money and not incur fees...so his bad, not yours!

I find it hard to believe its $470 worth of fees has your check bounced more than once? If your check bounces you are responsible for fees. Make sure you get a bank statement or some kind of offical letter stating the amount owed. |

Pay the fees your landlord is asking. Writing a bad check is a felony in most states. If your landlord wanted to pursue this he could bring criminal charges against you. |

You could call his bank and ask them to remove or lower the bank overdraft fees since it was not his fault this happened... they might get rid of the fees and then you won't have to pay them!
But if the fees stick, then you are responsible. Your landlord has a mortgage and bills to pay on that property and when you don't pay your rent you are basically stealing from him. |
