Yesterday I received a three day notice dated 11/13 that said "Pay amount due or property will be seized". I lived in Contra Costa County, California. Do I have any options or protections? |

I used to be a property manager and I too would sent out 3 day notices, but until a court has released eviction papers, they can't seize your property, you should be calling them up and letting them know when you plan to pay. This is normally accepted so long as it's not happening constantly. Good luck. |

So pay on the 17th...that will be the third day.
They issued a 3 day notice to protect themselves....so I'm assumming you notified them about your problem.
If you dont pay...all they can do is sue to have you removed and recieve payments and lawyers fees.
They cannot just walk in and throw you out. |

It's only two days away - see if you can write a post-dated check. They may tack on additional fees, but also, your rent must be pretty far behind - I don't think they'll attempt eviction if you're only missing that one payment. |

Have you tried contacting the owner or property manager? That should have been done the minute you knew rent would be late, but perhaps its not too late. Call and explain that you can make a payment on 11/17 and perhaps they will work with you.
If they refuse to wait ONE day for the rent then pay on the 16th but go into the office as late in the day as possible but before closing. If you go after 2pm, this will buy some time because typically it will be after the bank run/deposit...and even if they do deposit the check after 2pm chances are it won't hit your bank until 11/17. But if you do this, just be certain you will have the funds in your bank acct by the time the check clears. |

google your state and landlord/tenant laws....california has the most tenant favored laws in the country.....landlords can't spit w/out an actual Judgment.....Find out your time line and pay in full before the hearing.....The 3 Day Notice is just to start the legal clock.....however, if he actually put "seize property", my guess he doesn't know the law either and won't hesitate walking into your apt while you are at work. |

you should've gone and talked to your landlord as soon as you found out that you could not pay on time. usually they will work with you. you can still go and try to talk to them, but it may be too late. good luck! |

They can only evict you - they can't take your furnishings and such, they can't shut off utilities, they can't kick you out without going through the courts first. If you are able to pay by the day you're in court, you might be able to stave off the eviction. If they seize your property, call the police. All they can do legally is take you to court to be evicted. |

Aren't they supposed to give you 30 days before they can evict you. There are laws out there to protect you the rentor. |
