My renter is not evacutaing my property . gave one month notice , now not paying rent?
Please I need your help and advice.. We have rented one side of our duplex. Now I want my son to move to that side and rent our bigger portion out. Our tenant has given us trouble in the past by paying rents very late. We had verbally told him he needs to find a place to move out. Then we served him one month notice to move out . Now he is hiding and he has not paid the rent.
What should we do? Get a lawyer? Give him three day notice for not paying rents? Or what?

Legally you can do nothing until he is evicted by the court system.The Marshall will remove him and his belongings.
The changing lock bit will only get you sued and you would lose.

I don't know if a verbal notice will stand up in court. If you're a landlord, you should know about the eviction process. You have to contact a lawyer or the local court system. (And I hope this is true that he's not paying rent. It would be very wrong to kick him out just because your son wants the bigger side of the duplex.)

Slap a 3 day pay or quit on the tenant. If they do not pay then you need to go to the court house and start the eviction process.

Hopefully you sent the 30 day notice certified mail or had him sign a receipt for the notice as this will make your case stronger.

Once the judge order the tenant out the you can have the Sheriff's office forcefully remove the tenant; however the Sheriff will not usually do anything about the tenants property so you should bone up on what your legal responsibilities are to secure and protect the ex-tenants property is. Every state is different and you can be held liable if you do not try and return the persons possessions.

Hi, I am a trainee solicitor and currently work for citizens Advice Bureau. Do you have a lease in writing? Eviction procedure depends upon your tenants housing status. How long have you had this tenant? Usually you would have to give notice according to lease. Also you probably need to apply to your local county court for a possession order. Ring them and ask for details or go to local CAB or get back to me.

BOTH katie b & hotclaws are okay, because it is within your legal right; reside in Wi. & have rental property there. Am thankful have not had that problem---check references in the future---had step-daughter in ours also, that did not work out either so beware, with son even!!!

u need to go to local courthouse and get notice to quit tenancy on the grounds of nonpayment of rent
if he doesnt leave after that u need to file eviction notice
then he can go to court and tell why he shouldnt have to leave and u can tell why he shoiuld if his rent is not paid this is legal cause to evict then if he doesnt leave after ordered to the sheriff ummmm escorts him out
if u just lock him out it is an unlawful eviction and u can be held liable and fined an even in some cases prosecuted for it do not do this follow procedures it takes time but it can b done legally

If u r India donot file a case or this will take atleast 4-5 or more Years to resolve

Simple way is take Cheques of rent from him in advance bank a cheque get it dis honored & file suit under sec 420 of IPC & He will have to go to Jail. Make it like that

Occasionally a landlord will have to evict a tenant. The landlord must provide written notice to the tenant that the landlord is demanding possession of the unit. If the tenant fails to vacate the premises within 3 days (if eviction is for failure to pay rent, 7 days for all other reasons), the landlord must file a complaint in the County Court.

After the case is heard, the landlord will receive a final judgement. The landlord must then obtain a writ of possession, authorizing the sheriff to remove the tenant. The sheriff will give the tenant 24 hours notice prior to physically evicting the tenant.
