Liberty | My renters claim a 'flea' problem? |
They are new tenants. Two weeks after they moved in they claimed there was a flea problem. We've never lived there with our brood (three dogs, two cats). Also, they are the first people that we've rented to to allow pets. And we only did that because it was supposedly the child's pet and they were in foreclosure and blah blah. So now they are withholding rent and daring us to take them to court. I say eff you meet me in court then. But, I have to know, never a flea problem, no animals have lived in that house for the ten years we've owned it. I offered to send an exterminator if they took the animal of the premises. |

It would appear that since there were NO flea etc problem BEFORE they moved in as there were no animals ....
These people move in and sudenly there are fleas .... and THEY bring a dog ....
I'd go ahead and take them to court .... the evidence is on your side ...
There are things they can get at the vets to put on dogs to keep fleas and ticks off .. use it monthly for about $20 a month .... IF they want to keep their pet .
The flea problem is NOT yours ..since they created it .
Talk to your lawyer and have him go after them for the rent, the flea problem , and get them out ..they will be nothing but TROUBLE !! |

If there have been no pets there for 10 years except theirs then they had to have brought them in.
Even if there is a legitimate flea problem:
1. it is illegal for them to stop paying rent. Send them a 3 day pay or quite notice for not paying rent. That is perfectly legal in most states. Let them try to fight it in court. The burden fo proof is on them.
2. They legally must give you a chance to fix it before they can break their lease or take any other adverse action. If they refuse to allow the exterminator to do their job then they lose any ground they had.
They have not grounds to do anything here. Do not let your tenants bully you! You are better off without these trouble makers. |

wow! its illegal for them to withold rent. they have to pay and thats that. did you give them a lease? does it say anything about if there are any problems with the apartment/house that they write it down? if they said to you 2 weeks after they move din, technically they were in the right, bc there might have been fleas. it takes a week for eggs to hatch and they might have been from a cat or from grass. this is the time of year that fleas migrate in yards and make it to animals and then in your home, sometimes not even by animals, by your socks and shoes. i know,bc my inlaws have to treat their yard and the neighbors too. i was standing in their yard 2 days ago and got ate up with them and had to leave. so maybe they werent fibbing. they probibly feel mistreated in this situation and are upset that you wouldnt help them. so if it were me, i would offer the 1 time treatment of the place and if they have any more complaints, its on them.but, no they have no right o withold rent. plus, ask that they pay a pet fee. if they dont agree to that, then explain to them that they must take their dog to get treated and to bring you proof that the pet is flealess so that you dont blame them for the pest problem. |

These people are users. Let them take you to court, and counter sue for an eviction and damage for the fleas.
Flea eggs will lay dormant for a year or so, not 10.
But, no matter how they got there you can only treat them by treating the animal in the house.
If they are withholding rent they have tied your hands, you have no option other then to evict them. Fleas are not a problem that gives them any rights at all. |

Wow..first the sob story about foreclosure and it's the kids pet and then they have the gall to withhold rent? Most likely their furbag brought the fleas. If there hasn't been any animals in that house or living in that house how on earth would they get in, if not from a living animal? Fleas live on blood...if there wasn't a host...there wouldn't be fleas. I agree with the other guy..sounds like they came in with a plan. No wonder they lost their home. They sound irresponsible and want to blame others for what ails them. You have been generous offering an exterminator. I would give them a pay or quit notice, and start the eviction process. They sound like squatters. Maybe they lived rent free in that foreclosure for so long they don't think they need to pay for a roof over their heads! |

what state are you in. It might not be legal for them to withhold rent since there are certain circumstances. have you rented out the place before they moved in. Could the previous tenant possibly had a pet without you knowing about it.
Sounds like a joke to me this is what you tell them to do. This does come from a Exterminator and it's simple. Tell them to buy a powder flea killer maybe a couple of boxes ( which you could offer to pay for just tell them to include the receipt with the rent deduction ) depending on size of house.
1. Sprinkle on carpet.
2. Vaccum carpet (the vibration will break open unhatched eggs)
3. Sprinkle flea powder on carpet again.
4. Vaccum again
Tell them to repeat this once a week for 4 weeks problem solved. |

Fleas can stay dormant for many years and then come out of hibernation when an animal comes around. They smell the blood. I know this because I moved into a house that had been empty for several years, the landlord layed new carpet over the old carpet. After we lived there about a year, we got a cat,flea-free. Six weeks later, we were being eaten alive. It also takes more than one extermination to rid the fleas. You might offer to hire the exterminator if they will agree to deposit the rent in an escrow account. |

I agree with the last post, send in the first extermination, then let them know its their responsibility from there on out especially if they have animals in the house. But the part about holding back the rent money is disturbing to me, after the extermination demand payment and keep the meter running so to speak, don't let them by without paying, after that if there was any more issues I would seek legal council which is free from most lawyers, and start the eviction. #1 next time have a contract drawn up before hand covering issues such as pets,damage,late payments...etc..etc.. |

I don't know - I'll tell you this - I rented and like you are saying - was also "the first renter there who had a pet" (like i'm sure everyone follows that rule) and my cats who did not previously have fleas - got fleas. They were never allowed out of the apartment so it's not like I brought fleas home from somewhere. Hey anything is possible. I would go ahead and pay for an extermination - it isn't that expensive - and make sure they are aware if there is any other "flea problem" they will be financially responsible for it. Most landlords pay for extermination of some sort throughout the lease anyway noob. |
