Just had a call from our estate agent saying that our landlord is thinking of selling our rented property. Our contract runs out this summer and although the landlord is fully aware of that she might like to get the property back before that. This would not be too much of a problem for us since we have started looking at buying ourselves and it was the worst comes to the worst we could be staying at my partner's parents for a bit. I was just wondering if we take this to our advantage and agree to move earlier that the end of our contract in exchange of financial compensation from the landlord, is that possible at all and how much could we be looking at asking? |

Yes it is possible, but look at reality, in this real estate market what are the chances your landlord is going to find a buyer quickly who would need to be in this summer? versus the place sitting on the market for six months, then the landlord does not have to allow you out of the lease |

How is your proposal favorable to the landlord? Basically, you are wanting to be paid to move out when if you stayed the landlord would be making money from you. The lease should still be valid with a new property owner. What is more likely, you can pay to break your lease and move out early. Since there is a change in ownership, the new owner might be interested in letting you out the lease to get a clean start on the new place. The new owner could then do repairs and upgrades and then get a new tenant for a better rate. You might be convince the new owner to let you break the lease and not have to pay a penalty. |

EVERYTHING is subject to negotiation, but put any agreements in writing. Feel out the landlord first. If you sense he wants the property vacant make a reasonable offer. However some investors may actually want you there to generate income. I'd ask for something like the last month free and complete return of the full security deposit. |

Moving out early is in YOUR best interest, not your landlords.
Putting property up for sale and having tenants remain is a great selling feature for your landlord! People who purchase investment property LOVE to see the investment property is fully rented, so it is extremely unlikely that the landlord would want you to leave, let alone pay for you to leave. The landlord may actually pay to have you STAY so that prospective investors can invade your privacy while parading through your domain while you live there. It's in your best interest to move out ASAP. Furthermore, giving you a 60 day heads-up notice is not a bad notice, so you dont' have much legal ground to stand on---you can stay, but your rent will explode upwards. |

The tenancy is automatically transfered to the new property owner so its not in your current landlords interest if you leave early as it would help him sell the property quicker to a property investor since its rented and would start making money from the day the contract is signed.
Honestly I did say say his mad if he pays you to leave early.

Look at your tenancy agreement, I wouldn't think you have to move out until your agreement ends. I cant see him paying to get you out, the property market is a bit slow at the moment, it might take a while to sell & most contracts take a while to go through in anyway. By that time you may be out in anyway. |

The only way would be if the landlord had a prospective buyer who wanted to move into the property before your tenancy agreement was up.
Moving early actually would not benefit your landlord because whilst you are living there, the mortgage is still being paid, in full or part, if you moved out they would then have to still pay this, and some houses do not sell all that quickly.
We tried this at our last property we rented but landlady said we could move out early but we still had to stump up the full months rent if we wanted to go early, so we stayed put, and managed to put off a buyer at the same time.

Yeah, you're not likely to get any money from your landlord for moving out early, but you may be able to save money by leaving early with your landlord's permission, essentially mutually rescinding the lease. It's a good idea to just mention this to the landlord and see what she thinks about the situation. You may want to start by mentioning that you know she's looking to sell and would be willing to leave early for, say, one month's rent in a new place. Again, not likely to work for you, but a good way to start negotiations. |

Usually when a property is sold with tenant on a current lease...the lease follows the sale. You do not have to move out until the lease expires and the landlord does not have to pay you to leave early if it's your choice to leave. |
