If you are co-renting and she is on the lease, involve the property manager or landlord. If you are renting and she is not on the lease, move her stuff out and ask the landlord to re-key. If you own and do not have a written lease, find out the eviction rules for your state, follow them and if shes still there at the end, throw her stuff out and re-key.
If you own and do have a rental agreement, follow the guidelines in the contract. |

Is her name on the lease? Is yours? If her name is on the lease there is nothing you can do but if its not and yours is call the cops and they can get her to leave. |

how long has she been there? longer than 30 days? if so u need to serve her with a 30 day notice and then take a copy of the letter, file a court date and take her to court. u can sue her for back rent, etc. but personally if she refuses to leave i would make her life a living hell. i had a roommate try to do this to me, screw me over and refuse to leave. so i had people over every day being loud as hell, slammed doors, ran up and down the stairs at 5 in the morning. i basically made it impossible for her to want to stay another day and she was gone by the weekend! i say have some friends over and let them beat the crap oput of her and let her know every day shes still there she will get beat up until she clears out and is gone. |

Give her 30 days notice in writing and the proceed against her for eviction and rent payment (call your local landlord/tenant agency for help in proceeding). Tell her in writing that you'll excuse her rent if she leaves within 30 days and doesn't force you to take this into a court of law and write it off if she leaves after the 30 days. |

If you only have to wait one more weekend, then your best bet is to just wait. It will take you much longer to file papers to take her to court.
You can still file in order to collect any past due rent money, but, since she hasn't got any, your chances to collect are pretty slim.
However, before you file, check to be sure you have the proper documentation to prove she owes you money. Who holds the lease on the apartment? Do you have some kind of contract that shows she promised to pay rent? Is there any kind of documentation that shows she actually lived in the apartment?
Without this documentation, all she has to do is deny, deny and deny. |
