He can do anything he wants.....but he needs to find someone to fill in for his share of the rent, to do the right thing, which always does not happen. If they all default, you are responsible. You tried to do the kind thing by co-signing the lease, but sometimes that backfires. I hope that roommate makes a conscious effort to find a replacement to pay his share. |

If he signed the lease, he can in deed move out but, he is responsible for the remainder of the lease. Write him a nice letter explaining the length of time left on the lease and that you expect all payment to be on time or you will take legal action.
You will have to take him to small claims but as long as there was no wrong doing by anyone in the home, he is responsible for the payment as stated in the lease he signed.
Don't drop it. This is happening all over and these kids must be made to handle responsibility! |

Of course he is free to move, he may not care about his credit, and the landlord could care less because he has you on the hook by co-signing,
You can tell the roommate they are liable for their portion of the rent until they find a new roommate but good luck collecting that from a college student, so you end up paying the difference until you find a new one then sue the kid, |

Well he can do that but he may still be responsible for his portion of the rent. You should contact the owner, and ask how they want to handle the situation. Your son should find another roommate as soon as possible. |

Depends. Is the living quarters on campus? I lived in an apartment building on campus and we had to find subleters if we were to move out for any reason. If it is not on campus and he gave 30 day notice then yeah. He can do that. You just have to scramble to find another roommate. Also, why did you co sign with kids on an apartment? Are you the only co signer? I hope you are not. |

He needed to give at least 30-days notice, but you don't have to allow him off the lease and you can still hold him responsible for his share of the rent. You need to write a letter to him saying that he needs to be responsible and continue paying rent until he finds a replacement roommate or that you will sue him in small claims court. You and the other roommates need to be assertive and convince the roommate (and his parents) that you will take legal action.
Unfortunately, as a cosigner, you have all the liability and no protection. Ultimately, you're responsible to the landlord to make sure the rental agreement is paid. |

When I went to Radford University we ran into this issue. It sucks really. The only thing to do is that the rental company may find a new roommate for them if you all ask or you all are stuck splitting and paying the difference if they don't want a roommate. |

He is giving noticed so i don't see a problem with him moving out. They will have to find someone else to replace him. And he will have to have get his name removed from the lease. |
