No, you do not even have to tell if you are asked.

The only laws regarding a disclosure of death on the property apply to buyers only. Renters have no rights to this personal information, it is none of their business.

If a prior occupant of the rental unit died in the unit within the last three years, the owner or the owner's agent must disclose this fact to a prospective tenant when the tenant offers to rent or lease the unit. The owner or agent must disclose the manner of death, but is not required to disclose that the occupant was ill with, or died from, AIDS. However, the owner or agent cannot intentionally misrepresent the cause of death in response to a direct question.74

Only in California. I am not aware of any other state which requires disclosure of such a situation. I assume, of course, that the premises are now in proper condition for re-rental.

Unfortunately, I have first hand knowledge of this issue.

My wife's late husband shot himself in the head right in front of their 8-year-old daughter five years ago. It was a terrible mess for both, the cleanup for the landlord and emotionally for the family.

All states have disclosure laws that apply when a property is sold. Some of those laws require disclosing a death in the home, some do not. When you are renting, however, the disclosure laws do not apply because the property is not being sold.

The bottom line is the landlord does not have to tell a new tenant about the death.

No, you have no requirement to inform the tenant. Disclosure laws vary by state. I do not know of any disclosure laws to lease real estate, only when you sell real estate. Your obligation is to obtain a certificate of occupancy ( if required by local ordinance,where the property is located). Your obligation is to make sure the property is safe-that it has good locks, smoke detectors, carbon monoxide detectors, etc. and that the mechanicals all operate correctly. The sad history of your previous tenant has nothing to do with the new lessee.

C'mon dude, don't be an ***. Just tell them some **** took a knife across his jugular in the kitchen over the sink and there was a huge mess all over the house, especially on the old suede couches he owned.
