Unfortunately, I have first hand knowledge of this issue.
My wife's late husband shot himself in the head right in front of their 8-year-old daughter five years ago. It was a terrible mess for both, the cleanup for the landlord and emotionally for the family.
All states have disclosure laws that apply when a property is sold. Some of those laws require disclosing a death in the home, some do not. When you are renting, however, the disclosure laws do not apply because the property is not being sold.
The bottom line is the landlord does not have to tell a new tenant about the death. |

No, you have no requirement to inform the tenant. Disclosure laws vary by state. I do not know of any disclosure laws to lease real estate, only when you sell real estate. Your obligation is to obtain a certificate of occupancy ( if required by local ordinance,where the property is located). Your obligation is to make sure the property is safe-that it has good locks, smoke detectors, carbon monoxide detectors, etc. and that the mechanicals all operate correctly. The sad history of your previous tenant has nothing to do with the new lessee. |
