ethically and legally are 2 different questions.

legally- sure. Its contractually binding. Unless there is a clause for a proration, then you can (unless there is something abnormal about the rental contract)

ethically... the point of having it is so you have advanced notice to find a renter. I would say to the tenet that if I can find a renter we will let it go, they can pay for a full 30 days, or we will give them half of it back.

You ARE entitled to some damage since they are only giving you 5/6th of the notice your contract stipulates, but don't screw them over for a couple bucks- it will get you feedback online that will bite you in the end.

if he only gave you 25 days notice, you can keep 5 days rent, not the entire deposit.

I think this one of those "spirit of the rule, rather than the letter or the rule" situations. We're only talking about a 5 day lapse here, so I would consider their reasons for leaving, why they were late in giving notice, and their track record as tenants. Moving residences is a stressful, complicated task and they may have just been too distracted to remember.
If 25 days is enough time for you to get a cleaning crew together and put out an add in the paper for the apartment, then give the benefit of the doubt. If your tenants are just milking the system, a certain amount of deposit can probably be legally taken.

talk to them to see if they leave the place in good conditions
and if they're willing to help you to get it ready for the next tenant
explain to them that and about the timely notice most likely they're willing to help by doing extra try to get inside the apt. and do a walk to see how is it some times all it need is some paint and cleaning they might offer them self to do it if you buy the material that along makes up and saves you in labor besides your giving them the deposit back is win ,win situation

Legally you can. If he had been a good tenant and it was a honest mistake, I would return 1/2 of it. But then you don't have to.

What do your state or provincial tenancy laws say? Make sure you know where you stand legally.

Was a lease involved or is this a month to month rental. If it's a year or six month lease and they have fulfilled the minimum occupancy requirment I would advise them they are a week late giving notice and as long as you are able to rent they will get the deposit back.

However, if they've also broken the minimum term and you're going to incur costs re-renting the suite, advertising, painting, rekeying locks etc, then yes you can legally and in good conscience keep the deposit.

If it's month to month, again as long as you rent it give them they're security deposit back - it's good Karma ;-)
