a lease is a lease,that is why you have a tenant sign a lease so this won't happen. first of all no return of deposit and if she is leaving the state your are sol. i would attach her belongings in lieu of lost revenue. I really doubt that she is telling the truth,i would guess she has alternative motives,and by saying her mother has cancer, in her eyes makes it alright.

If what she says is true, let her go! Cancer sucks. Why end up having to file a claim against her for non payment? put an ad in the paper now or notify your management company and get her out of there! If it were MY renters, I'd be having a PARTY. I hate them. I really do. Sorry, but I do.

well, if she has to move to Texas for her mother, theres not much to do. all I can really say is let her go and get a new tenant as soon as you can so you dont lose out on money. |

Nothing much you can do except find a new tennat right away and also ask the current tenant to pay you $500 bucks to break the lease so as to compenate you. You also tell her if she pay you the fee you won't record her as nad tenant on her credit.
The problem is what if she is really broke and lost her job? Ask her to show you the pink slip that she really lost her job or call her employer to find out if she is telling the truth. If she is telling the truth, maybe as a human being we should give her a break and just let her go to take care of her sick mother.
Life is tough for sure now because we have dumb politicians destroying this great nation. |

suggest they get a job! it is totally irrevelant why they are moving- unless it is stated in the lease. they are liable for the entire lease and you can get a judgement for the full amount of the lease, and then turn it over to a collection agency. they will collect the money owed. collection agencies always catch up with them and you will get paid. |

ok saying here if it is true her mother does have cancer it's pretty low and a sick thing for you to be worrying about your rent money.
Let her go and move someone else in and she does not have to show you prof her mother has cancer "medical privacy act" so you just I guess have to take her word. |

Legally, the lease is binding and the tenant is liable for the rent until either the lease expires or a replacement tenant is found. The tenant is also liable for any costs you incur due to her breach of lease, such as advertising costs, etc.
You, as the landlord, have an obligation to mitigate your own damages by attempting to find a replacement tenant ASAP.
Legally, you can sue the tenant for the above mentioned amounts or any amounts due after the security deposit has been depleted.
You can deduct the above mentioned costs from the tenant's security deposit. You cannot just keep the deposit, you must send an accounting of it per Texas state landlord tenant laws.
The reality is that the tenant is moving out of state, which makes serving her for a lawsuit and collecting on the judgment harder. Judgments can be renewed for up to 20 years, so the judgment will be valid for quite some time.
You need to decide how much you are out by just letting her go and deducting from the deposit and if it is worth it to spend money obtaining and chasing after a judgment in order to collect. |

You have a few choices, you could allow her to break the lease, you could sue her, for the balance of the lease, which may cost you more than the balance itself, or you could allow her to sublet the property. Laws vary from state to state and this is not a legal opinion.
My father had rental property in Pa and that is what I am basing my opinion on.If you sue, you probably won't see any money from her. |
